Applicant's Variance Request
Applicant in Docket #2022-0001 is requesting a variance to Appendix A, Article 7, Table 7-4a to classify a proposed new
bungalow style Single Family Structure as old stock housing to allow a one(1)garage parking space where a minimum of two
(2)garage parking spaces are required.
Background Information
The applicant is proposing to demolish an existing 2 Story Single Family Structure and an existing 2 story detached
garage and then construct a new 2 story bungalow style Single Family Structure with an attached garage and one (1)
garage parking space.
Appendix A,Article 7,Table 7-4a:Garage Space requires a minimum 2.0[garage parking spaces]per DU(1.0 per DU for old
stock housing);each must be enclosed or semi-enclosed and adjoin a driveway.Maximum 1.0 per 2,225 square feet of building
site area,not to exceed 4.0.
The site currently consists of 1 lot 50'x100' located at 5804 Fordham Street.
• All new homes(homes constructed after adoption of old stock housing rule in 2005) on 5,000 square foot lots in
West University Place have a two(2)car garage.
Section 2-102 of Appendix A defines "Old stock housing" as "One or more buildings on a SFD site meeting all the
following criteria, at any given time: (i) the principal building was built before 1980, and(ii) the gross floor area of all
buildings on the site(at any given time)does not exceed the greater of 3,400 square feet or 200 percent of the gross floor
area of all the buildings on the site when the principal building was built."
• The Applicant seeks a variance for a building to be constructed on the SFD site after January 27,2022.
Section 10-100, Off-Street Parking of the City's zoning ordinance requires that new construction on the building site
have a two-car garage and one additional off-street parking space.
Requirements and Required Findings:
In order to authorize a variance from the Zoning Ordinance,the ZBA must find that:
(1) The proposed variance is not contrary to the public interest;
(2) Due to special conditions, a literal enforcement of the zoning ordinance would result in unnecessary
hardship; and
(3) That the proposed variance would be consistent with the spirit of the Zoning Ordinance and would result in
substantial justice being done.

Here staff recommends the denial of the variance because:
(a) The construction of a home with reduced garage space and off-street parking would not be in the public
interest due to on-street parking congestion in the City's residential district;
(b) There are no special conditions related to the proposed building site of the Applicant; it is a typical 5,000
square foot lot and building site;
(c) A requirement for a two car garage on a residential building site does not cause unnecessary hardship;
(d) All new single-family residential structures in West University Place have had a two-car garage since at least
2005;and two car garages appear to be common for new residential structures in the area;
(e) The allowance of a one-car garage for a new residential structure would be inconsistent with both the literal
wording and the spirt of Zoning Ordinance which attempts to provide reasonable off-street parking
requirements.
(f) The allowance of a one-car garage would be inconsistent with the spirit of the Zoning Ordinance and result
in injustice because it would allow atypical new construction in the City's single-family residential district.
Staff Recommendation
Staff recommends denial of the request for a variance to Appendix A, Article 7, Table 7-4a, to classify the structure as
old stock housing and to allow the construction of a new principal dwelling on the building site with 1.0 garage parking
space where a minimum of 2.0 garage parking spaces are required.

Address of building site/property: 5804 Fordham Street, Houston, TX 77005.
Legal description of the Property: LOT 6, BLOCK 3, Preston Place, Harris County, Texas. An addition in Harris
County, Texas according to the Map or Plat Thereof Recorded in Volume 572, Page 318 of the deed Records of
Harris County, Texas.
Applicant: Scott and Jennifer Allison
Decision or Action Requested: The Applicant is requesting a variance to Appendix A, Article 7, Table 7-4a, to
allow 1.0 garage parking space where a minimum of 2.0 garage parking spaces are required, and to classify
applicant's proposed new construction as "old stock housing".
Notice, Hearing, Findings, Vote:
(X) Notice of the hearing was given by: regular mail (to nearby property owners) and by posting on-site in
accordance with Article 11 of the Zoning Ordinance, by Alfonso Acosta, Building Official, City of West
University Place, Texas.
(X) The Hearing was held on: January 27, 2022. All plans, documents, and letters contained in the City's files
and submitted at the hearing regarding this matter are made a part of the record of this hearing.
(X) The Zoning Board of Adjustment finds that:
1) the Applicant's request for variances is contrary to the public interest because, among other things, it
would reduce available off-street parking and potentially encourage on-street parking further congesting the
streets in the residential neighborhood;
2) the Applicant's request for variance is not justified by any special conditions or prior use of the property
because:
a) the site currently consists of one typical 50'x100' (5,000 sq. feet) lot which contains (or
contained) a two (2) story single family structure and a two (2) story detached two (2) car garage;
and
b) new homes on 5,000 square foot lots in West University Place typically have a two (2) car
garage.
3) the Applicant's request for variance is not needed to avoid unnecessary hardship in the use of the
property by the Applicant;
a) the Applicant presented no evidence that providing 2.0 garage spaces on the building site is a
hardship; and
b) new homes on 5,000 square foot lots in West University place typically have a two (2) car
garage; and

4) the Applicant's hardship, if any, is self-imposed, or a result of Applicant's desire to construct a building
and use the property in a manner inconsistent with the City's Zoning Ordinance; and
5) the Applicant's request for variance is not in keeping with the spirit of the Zoning Ordinance.
(X) Additional findings (if any):
1) The Applicant's proposed structure does not meet the definition of old stock housing. The Board of
Adjustment does not have the authority to grant a variance to a defined term of the Zoning Ordinance.
Section 2-102 of Appendix A defines "Old stock housing" as "One or more buildings on a SFD site
meeting all the following criteria, at any given time: (i) the principal building was built before 1980, and
(ii) the gross floor area of all buildings on the site (at any given time) does not exceed the greater of 3,400
square feet or 200 percent of the gross floor area of all the buildings on the site when the principal building
was built." (emphasis added). The Applicant seeks a variance for a building to be constructed on the SFD
site after January 27, 2022.
2) Section 10-100, Off-street parking, of the Zoning Ordinance also provides, in part:
"There must be off-street parking spaces for each occupied building space within the city, as set out below, and
subject to the other provisions of this ordinance:
Use of Minimum number of parking spaces

SFD use. The number of garage parking spaces required by Article 7 plus one additional space located
between the required garage spaces(s) and the public roadway. The additional space may be on the
building site or in the adjacent street area(or partly in each), but may not encroach upon any part
of a public sidewalk(existing or proposed) or the roadway.
Section 10-100 of the City's zoning ordinance requires that new construction on the building site have a two-car
garage and one additional off-street parking space.
3) Section 70-60 of the City's Code of Ordinances provides other general driveway and sidewalk
requirements, including requirement that any garage door must be a minimum of 18 feet from the property
line of any abutting street.
Decision of the Zoning Board of Adjustment denying the request for a variance (subject to all applicable
appeals): After hearing the evidence, presentation and comments of all concerned, the Board of Adjustment voted
to deny the variance to Appendix A, Article 7, Table 7-4a, to classify the structure as old stock housing and to
allow the construction of a new principal dwelling on the building site with 1.0 garage parking space where a
minimum of 2.0 garage parking spaces are required. The proposed structures are not, by definition, old stock
housing, and there is no authority for the ZBA to grant a variance to the defined terms of the Zoning Ordinance.
There is nothing unique about the lot to support a variance to the required 2.0 garage parking spaces. A 2-car
garage is (or was) located on the property. The Applicant have not shown that a variance to the Zoning Ordinance
is required by any hardship. The Applicant have not shown that the proposed variance observes the spirit of the
Zoning Ordinance, or is required so that substantial justice is done.
THIS DECISION APPLIES ONLY TO THE SPECIFIC ITEMS DEFINED ABOVE. IT DOES NOT APPLY TO
ANY OTHER ASPECT, USE OR PART OF THE SITE OR STRUCTURE IN QUESTION, NOR DOES IT
APPLY TO ANY OTHER ACTIVITY, SITE OR STRUCTURE. TO OBTAIN A RULING FOR ANY OTHER
ITEM REQUIRES SEPARATE APPLICATION, NOTICE, HEARING, PROOF AND BOARD FINDINGS.

NOTICE OF ZONING BOARD OF ADJUSTMENT HEARING
The Zoning Board of Adjustment ("ZBA") of the City of West University Place, Texas ("City") will hold a
public hearing in the Municipal Building, 3800 University Boulevard, City of West University Place, Texas
77005, during a meeting set to begin at 6:30 p.m. on January 27, 2022. The hearing may be recessed and
continued to a ZBA meeting set to begin at 6:30 p.m. on February 24, 2022. The purpose of the hearing is
to provide an opportunity for all persons to be heard in relation to the following matter:

Action Requested: Requesting a variance to Appendix A,Article 7, Table 7-4a,
Garage Space to allow a one car garage.
Additional Details: The applicant is requesting a variance to Appendix A, Article 7, Table 7-4a, to classify
the structure as old stock housing to allow 1.0 garage parking space where a minimum of 2.0 garage parking
spaces are required.
Applicable regulations include the City's Zoning Ordinance, Code of Ordinances, Chapter 211 of the Texas
Local Government Code and the rules of the ZBA. The application is available on the city's website at

RE: ZBA Docket No. 2022-0001, regarding property at 5804 Fordham St., Houston, TX 77005 (Variance).
Evaluation of the requested variance should consider the nature of the structure. As an "accessory structure"
to an existing property, which it appears to be, the presence or absence of a garage is immaterial. However, as
a primary structure that could eventually be a standalone dwelling, it should have the same two-car garage
requirement of all other structures. Garages are a key feature for easing the street-parking situation.
Given that the structure is not proposed as an "accessory structure", the variance should be denied. Even as an
"accessory structure", consideration may be necessary to permit an extra curb cut and assure the driveway
leads to a garage.
