Notices, Rules,Etc. Bruce Beneke welcomed BSC members and staff to the meeting. 2. Meeting Minutes. Jim Craig made a motion to approve the October 1, 2020 meeting minutes with a revision to Item 3 Stucco to state that City was to add additional inspection during installations. Gerry Spedale seconded. AYES: Bruce Beneke, James Craig, Charles Marshall, Eddie Mathews, Muddy McDaniel, Gerry Spedale. NOES: None. ABSTAIN: None. Meeting minutes approved as amended. 3. Docket 2020-0013 Property located at 3204 Nottingham, West University, Texas 77005 regarding a variance of Article VII Fences Section 18-202 Prohibition in Front or Side Yard Jim Craig made a motion to start the hearing. Eddie Matthews seconded. AYES: Bruce Beneke,James Craig,Charles Marshall,Eddie Mathews,Muddy McDaniel, Gerry Spedale NOES: None. ABSTAIN: None. Bruce Beneke swore-in all attending guests that wanted to speak in favor and/or opposition of the variance request. Clay Chew stated that a fence permit was issued in error triggering the variance request and the reasons for declining a permit. Mr. Lindley then represented on behalf of the Reid's their situation and point-of-view as to why the variance request should be granted. 3204 Nottingham was originally platted with a Buffalo Speedway address, at an unknown time, the house was reassigned a Nottingham address making the old front yard and required setbacks obsolete. 1111 3800 University Boulevard I West University Place, TX 77005 I www.westutx.gov The City of West University Place A Neighborhood City This was followed by a broad discussion of the application,questions thereon for the Reids and ordinance issues between Commission members, staff and applicants. Dick Yehle felt that it was important for the City to defend its ordinances; there are other residents in similar circumstances who wish for a fence. Bruce Beneke then closed the public hearing. Commission's meeting was re-opened for member discussion. Bruce Beneke and staff both advised that Commission could approve variance request with conditions; such as no fence to be permitted on Nottingham frontage. Jim Craig proposed that Commission go through the "Guide for Variance Consideration" which was led by Bruce Beneke. After this review and discussion Jim Craig made a motion to approve the variance request for a fence as shown in the application subject to no fence being permitted along the Nottingham property line. Seconded by Charles Marshall. AYES: Bruce Beneke, Jim Craig, Charles Marshall, Muddy McDaniel and Gerry Spedale NOES: none ABSTAIN: None. Motion to conclude hearing made by Muddy McDaniel.
