Background Information The site is located at 4121 Judson Avenue and is an irregular shaped lot. The existing home has a 10 foot front building line and was built in 1945. Variance Request Applicant is requesting a variance to build an addition to an old stock home with a 10 foot front building line setback. Staff believes that the ZBA has the authority to grant this variance according to Section 11-104 Variances for old stock housing. (1) The ZBA has made all findings and determinations required by state law for the granting of a variance. A "special condition" or "hardship" that is self- created, personal or based only on financial reasons is not sufficient to support the issuance of a variance. (2) The ZBA has made any additional findings and determinations required by a specific provision of this section which relates to the variance. (3) The variance has been reduced to writing and includes any conditions prescribed by the ZBA or required by this section for the variance in question. The findings to grant a favorable result for this application are as follows: (1) The ZBA must find that a literal enforcement of the ordinance would result in an unnecessary hardship. (2) By granting the variance would the spirit of the ordinance be observed and substantial justice done? The proposed parking area is not connected to a garage or located behind the front building line and is not authorized without a special exception from the ZBA. Table 7-5a Note 7 authorizes the ZBA to issue a special exception Note 7. Special Exceptions. The ZBA may issue a special exception for a parking area, garage or driveway (or other maneuvering area) in another location or with a different design than prescribed by this ordinance, if it finds that: (i) the other location or design will not unreasonably interfere with available light and air and will not significantly alter access for fire-fighting and similar needs; (ii) the other location or design will prevent the destruction of a qualified tree; (iii) in the case of the remodeling of a principal building, the location requested is the same location as an existing parking area, garage or driveway; or (iv) the location or design requested is necessary for safety considerations. 3826 Amherst St. www.westutx.gov West University Place, TX 77005 713-662-5830 Sec. 74-76. Variances. (a) Unnecessary hardship standard. The ZPC may authorize a variance when an applicant can show that a provision of these regulations: (1) Would cause unnecessary hardship if strictly adhered to; and (2) Is because of a physical condition peculiar to the land. (b) Procedural requirements. (1) Any variance authorized is required to be entered in writing into the minutes of ZPC meeting specifically stating the reason(s) for which the variance was approved. (2) Not less than two-thirds of the entire membership of the ZPC (not just those present at the meeting) must approve the request. (c) Required notice. See V.T.C.A. This variance proposes to maintain the existing 10-foot setback away from the front property line. The shape/orientation and size of the lot makes it inordinately difficult to make reasonable use of the property and still obey the 20-foot zoning ordinance. The property was purchased in 2012 and underwent an extended renovation in 2016 to improve the look of the property. Throughout the years our family size has increased from 1 to 3 children and kids have grown (ages 14, 12, and 7)to the point that we have outgrown the house. We are very fond of West U and we would like to continue living in West U and preserve the original bungalow concept of the home rather than tearing it down and renovating. The proposed extension would be to accommodate the construction of 2 bedrooms, 2 baths,and a new laundry and still keep a reasonably sized green space to sit down and enjoy an outdoor outing. Furthermore,with the growth of our family we anticipate that additional parking space will also be required and thus would also like to request an Exception to build a concrete slab in order to manage parking on the front of the East wing of the property. Judson Avenue tends to become easily congested when parking on the street and thus to alleviate this burden we also want to expand our parking options for this double reason. As a long time resident and my father was raised here and worked at JMH and my grandparents bought in the 40's on Case, the building codes and ordinances are a primary reason our real estate has gained in value. If we are to allow a variance here, why not everywhere and thus our property values begin to lose their growth rate. Unfortunately, the buyer should have done a better job of understanding the situation of the particular house before purchasing. I built in 2010 and worked very closely with the City inspectors and the approval process. I got to know Clay pretty well and he helped guide me to make sure I met every code in the book. I paid a lot of money to replace trees displaced on my property and made sure I did fully meet all of my permitting requirements. I see no reason to grant a variance in this case since it would allow parking in the front yard and he an eye sore.
