AN ORDINANCE FINDING AND DETERMINING THAT THE CONSTRUCTION
OF A MONOLITHIC STORM SEWER AT THE FOLLOWING LOCATIONS:
ALONG MILTON STREET EAST FROM THE INTERSECTION OF COLLEGE
TO POOR' FARM DITCH; -3y}00 BLOCK OF TANGLEY WEST FROM THE
INTERSECTION OF :MERCER TO POOR FARM DITCH; AND REINFORCED
CONCRETE PIPE FROM THE NORTH SIDE OF THE INTERSECTION OF
RICE BOULEVARD SOUTH TO THE INTERSECTION OF :M:ILTON STREET;
AND THE 3600 BLOCK OF AMHERST WEST FROM THE, INTERSECTION
OF MERCER TO POOR FARM DITCH IN THE CITY OF WEST UNIVERSJTY
PLACE,TEXAS AS PROVIDED IN ORDINANCE:NUMBER 842, AWARDING
,A CONTRACT TO THE JOHN G. HOLLAND CONSTRUCTION COMPANY;
APPROVING THE CITY ENGINEER t S FINAiLEESTIMATE AND ACCEJ;>TING
A STATEMENT FROM CONSULTING ENGINEERS, LOCKWOOD, ANDREwS
~ NEWNAM, INC., THAT SArp STORM, pEWER HAS l3EEN SATIS-
FACTORILY COMPLETED IN ACCORDANCE, WITH' PLANS AND SPECIFI-
CATIONS AND AUTHORIZING AND DIRECTING' 'SE'].'l!LEME~ IN ' , , '
ACCORDANCE WITH THEIR RECOMMENDATIONS; AND AUTHORIZING
A REMAINDER OF $1,307.04 RETURNED TO THE GENERAL FUND, AS
APPROPRIATED IN ORDINANCE :NUJYJBER 841. '

WHEREAS, pursuant to Ordinance number 842, p~ssed and approved
on July 27, :1964, determining the necessity for and ordering the construc-
tion of storm sewer improvements at the following locations in the City
of West University Place, Texas:
Along Milton Street east from the intersection of College to
Ooor Farm :Ditch
3600 Block of Tangley west from the intersection of Mercer
to Poor Farm Ditch
From the north side of the intersecti~n of Rice Boulevarg
south to the intersection of Milton Street
3600 Block of Amherst west from the intersection of Mercer
to Poor Farm Ditch,
made and entered into a contract with the
Company dated the 28th day of July, 1964,
storm sewer improvements at the locations
John G. Holland Construction
for the construction of said
as stated herein; a~d
WHEREAS, said Contractor has now completed the imppovements
under said contract and has completed the work as set forth in the, Ordi-
nance and contract, and the, City Engineer andConstulting Engineers have
made their recommendation and certif:i,cationwith reference to completion
of said work and said final estimate has been presented in connection
therewith.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WEST UNIVERSJTY PLACE, TEXAS:

1. That the Gi ty Commission hereby finds and determines
that it was necessary to increase the contract by the sum of $3,259.96
for extra work consisting of repair and replacement of concrete in the
3600 block of Amherst and Tangley and tl:e lowering of a 611 water line
at Milton and AudenStreets, and to increase the cubic yardage of
stabilized sand for backfill purposes as set forth in the original
proposal. Such extra work and improvements increasing the total
amount of the contract due and payable to Hthe John G.Holland Con-
struction Company to the total sum of $91,192.96.

2. That the City Commission hereby determines that Consult-
ing Engineers, Lockwood, Andrews and Newnam, Inc., have certified that
on the date of November 23,1964 that said storm sewer project has
been satisfactorily completed by the John G. Holland Construction
Company in accordance with plans-and specifications, and recommend
final acceptance and payment.:
3. That the John G. Holland Construction Company has filed
with the City of West University Place, Texas a certificate of final
completion of the heretofore mentioned storm sewer project, certifying
that all materials, labor and e~uipment and all sub-contractors used or
employed in the work have been paid in fUll for materials and services
rendered.
4. That the acceptance of.the work and the final settlement
with the contractor, as herein provided, shall in no wise release
contractor and its surety from the terms and provisions of its bond,
but same shall remain in full force and extend with the one-year main-
tenance guarantee provided in the contract.

5. The City Commission, having examined the final estimate
prepared by the City Engineer with reference to the completion of said
improvements, hereby authorizes and directs the Mayor and the City
Treasurer to make final settlement with said contractor in accordance
with the final amount of the contract, including extra work, totaling
$91,192.96, the final estimate to the contractor amounting to $9,119.30
which represents the final 10% of the contract retainage.
6. The City Commission finds there is an unused amount of
$1,307.04 of the $92,500 appropriated under Ordinance numbeh 841, not
needed or re~uired to satisfy final payment of the John G. Holland
Construction Company contract and is therefore ordered returned to
the General Fund.
