HomeMy WebLinkAboutOrder No. 2020-02 Allowing Temporary Variance for Outdoor Tens in Comercial ZoneORDER NO. 2020-02 AN ORDER OF THE MAYOR OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS WHEREAS, on March 11, 2020, the County Judge of Harris County Texas declared a local state of disaster pursuant to the provisions of Chapter 418, Texas Government Code and in response to the imminent threat to public health and safety posed by COVID-19; and WHEREAS, on March 17, 2020, the Mayor of the City of West University Place, Texas issued a mayoral proclamation declaring a local state of disaster due to public health emergency for the City of West University Place, Texas in response to, and to help prevent and control, COVID-19; and WHEREAS, on March 23, 2020, the City Council of the City of West University Place, Texas passed a resolution continuing the Declaration of Local State of Disaster executed by the Mayor in response to the threat posed by COVID-19; and WHEREAS, on March 24, 2020 the County Judge of Harris County, Texas issued a Stay - At -Home Order for all of Harris County, including the City of West University Place, Texas, to protect public health and safety; and WHEREAS, the Mayor of the City of West University Place, Texas has determined that the recommendations of the State for social distancing and meeting outside are in the best interest for health and safety; and WHEREAS, the Mayor of the City of West University Place, Texas has further determined that a temporary variance to allow an outdoor tent to be erected in a commercial zone is necessary to protect students of St. Marks School from the elements, and to allow them to gather outside while increasing the ability for social distancing and interaction with other students. NOW THEREFORE, I, MAYOR OF THE CITY OF WEST UNIVERSITY PLACE TEXAS, HEREBY FIND AND ORDER: SECTION 1. That, the findings and recitals set out in the preamble of this Order are found to be true and correct and are made a part hereof for all purposes. SECTION 2. That, while Section 2-102 of the Zoning Code is in the best long-term interest of the residents of West University Place, allowing the temporary installation of an outdoor tent is in the best short-term interest of the students of St. Marks School in response to the threat posed by COVID-19. SECTION 3. That, a temporary variance to Section 2-102 of the Zoning Code is granted to the St. Marks School to allow the installation of an outdoor tent in a commercial zone for the duration of this Order. SECTION 4. That, in accordance with Chapter 418, Texas Government Code, this Order shall take effect immediately at 1:23 am on October 1 , 2020 and shall terminate upon the expiration of the City of West University Place declared emergency related to the COVID-19 virus referenced herein. 100208638.docx ) SO DECLARED AND ORDERED, this the 1st day of October , 2020.
