ORDINANCE NO. 821
AN OJmINANCE FINDING AND DETERMINING THAT EACH. AND ALL OF THE
PROCEEDINGS HAVE BEEN HAD AlID ALL THINGS DONE PREREQUISITE TO
THE HOLDING OF A PUBLIC HEARING TO CONSlDER THE AMENDING OF
ZONING ORDINANCE NO. 111 OF THE CITY OF WEST Ul'ilVEft5ITY PLACE,
TEXAS, SO AS TO PERMIT AN EXTENSION OF IMPROVEMENTS D'rO THE
SETBACK LINES ESTABLISHED FOR BISSONNET STREET AND KIRBY DRIVE;
FINDING THAT' A PUBLIC BEARING FOR THE PURPeSE OF CONSIDERING AN
AMENDMEN'r TO ORDINANCE NO. llllfAS BEEN DULY AND, :rEGALLY HELD
APPROVING AM) ADOPrING 'fBE REPORTED RECOMMENDATION OF THE ZONING
Am> PLAl4NING BOARD THAT ORDINANCE NO. 111 BE AMENDED SO AS TO
PERMIT SUCH EX'.rENSION; FINDING THAT ORDINANCE N0. 111 OF THE
CITY OF WEST UNIVERSITY PLACE SHOULD BE SO AMENDED; AMENDING
ORDINANCE NO. 111 PERMITTING SUCH EXTENSION mro SAID SETBACK
LINES; REFEALING ORDINANCE NO. 817; AND PROVIDING AN EFFECTIVE,
DATE.

WHEREAS, Continental Oil Company, Lessee of a 130 X 130 foot tract of land at
the intersection of Bissonnet Street and Kirby Drive has heretofore duly and
properly requested permission to extend sertain improvements into the set-
back lines established for improvements at the said intersection; and
WBEBEAS, the Zoning and Planning Board of the City of West University Place,
having considered the said request of Continental Oil Company has submitted
its recommendation that the same should be granted subject to a pUblic hear-
ing before the City Commission of said City; and
WHEREAS, a proper, notice of such hearing was given by publication in the
Houston Chronicae and notice was mailed to each of the owners of property
within 200 feet of the aforesaid lot; and

WEEREAS, pursuant to such notice a public hearing was held by the City Com-
mission at the City Hall, 3800 University BOUlevard, at 7:00 o'clock p.m.,
Monday, January 28, 1963; and
WHEREAS, the City Commission is of the opinion that the request of Continental
Oil Company should be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
Section 1: 'That the City Commission of the City of West University Place
hereby finds and determines that all formalities required by Ordinance No.
111 of said City r~lative to the request of Continental Oil Oompany for an
amendment to said Ordinance to permit the extension of improvements into the
setback lines established at the intersection of Bissonnet Street and Kirby
Drive have been met.
Section 2: That the report and recommendation of the Zoning and Planning
Board relative to the request of Continental Oil Company be, and it is hereby,
approved and adopted.
Section 3: That Section 29 of Ordinance No. 111 of the City of West University
Place, Texas, is hereby amended by the addition of a sub-paragraph to be known

as sub-paragraph No. 13 to read as follows:
" (LII) in connection with the construction of a gasoline service station at
the intersection of Bissonnet street and Kirby Drive on a tract of land
fronting 130 X 130 feet on each street the construction ofa pump island to
project 8 feet in~o the 30 foot established' setback l~ne and an overhead
canopy to project '13 feet into said established 30 foot setback l~ne shall be
permitted on Kirby Drive and the construction of a pump island to project 14
feet into the 30 foot established setback line and an overhead canopy to pro-
ject 1& feet into the established 30 foot setback line on Bissonnet street
shall be permitted, provided however, ,that any improvements placed on the
aforesaid tract of land shall in all other things comply with the existing
ordinances and the Building Oode of the City of West University Place, Texas."
Section 4: That Ordinance No. 817 is hereby repealed and shall be of no fur-
ther force and effect.
Section 5: This Ordinance shall take effect and be in force immediately from
and after its passage and approval.
