ORDINANCE NO. 817
AN ORDINANCE FIlIDING MID DETERMINING THAT EACH AND ALL
OF TEE PROCEEDINGS HAVE BEEN HAD MID ALL THINGS DONE
PREREQUISITE TO TEE HOLDING OF A- PUBLIC REARING TO CON-
SIDER TEE AMENDING OF ZONING ORDINANCE NO.lll OF TEE CITY
OF 'WEST UNIVERSITY PLACE, TEXAS, 'SO AS TO PERMIT AN
EXTENSION OF IMPROVEMENTS INTO THE SETBACK LINES ESTAB-
LISBED' FOR BISSONNET S'l'R.nT' AND KIRBY DRIVE; FINDING
THAT A PUBLIC, EEARI;NG FOR TEE ,PURPOSE OF CONSIDERING
AN AMENDMENT TO ORDINANCE NO.lll HAS BEEN DULY MID
LEGALLY EELD APPROVING AND ADOPl'ING TEE REPORTED RE-
COMMENDATION OF THE ZONING AND 'PlANNING BOARD THAT
ORDINANCE NO.'lll BE AMENDED SO AS TO PERMIT SUCH EX-
TENSION ; FINDING THAT ORDINANCE NO. HI OF TEE CITY OF
'WEST UNIVERSITY PLACE SHOUIJ) BE SO AMENDED; AMENDING
ORDINANCE NO.lll PERMITrING SUCH EXTENSION INTO SAID
SETBACK LDlES; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Continental Oil Company, Lessee of a 130x130 foot tract
of land at the intersection of ~issonnet Str~et and Kirby Drive has
heretofore duly and properly requested permission to extend certain im-
provements into the se~b~ck li~es ~stablishedfor improvements at the
said {ntersection; and
WHEREAS, the Zoning ~nd Plan~ing Bqard of the City of West Uni-
versity f,lace, having considered the said request of Continental Oil
Company has submitted its recommendation that the same should be granted
subject to a public hearing before the City Commission of said City;and
WHEREAS, a proper notice of such hearing was given by publica-
tion in the Houston Chronicle and notice was mailed to each of the
owners of property within 200 ,feet of the aforesaid lot~; and

WHEREAS, pursuant to such notice a public hearing was held by
the City Commission at the City Hall, 3800 University BOUlevard, at
7:30 P.M., Monday, October' 22, 1962; and
WHEREAS, the City Commission is of the opinion that the request
of Continental Oil Company should be granted:
NOW, TEEREFORE, BE IT ORDAINED BY TEE CITY COMMISSION OF, TEE
CITY OF 'WEST UNIVERSITY PLACE, TEXAS:

Section 1. That the City Commission df'the City of West Uni-
versity Place hereby finds and determines ,that all formalities(required
by Ordinance No. III of said Ci~y relative to the request of Continental
Oil Company for an amendment to said Ordinance to permit the extension
of improvements into the setback lines established at the inter-
section of Bissonnet 8tfteet and Kirby Drive have been met.
Section 2. That the report and recommendation of the Zoning
and Planning Board relative to the request of Continental Oil Company
be, and it is hereby, approved and adopted.
Section 3. That Section 29 of Ordinance No. III of the
City of West University Place, Texas, is hereby amended by the ad-

dition of a sub-paragraph to be known as sub-paragraph No. 13 to read
as follows;

tI (13) in connection with the construction of a gasoline
service station at the intersection of Bissonnet Street
and Kirby Drive on a tract of land fronting 130x130
feet on each street the construction of a pump island
to project 5 feet into the 30 foot established setback
line and an overhead canopy to project 13 feet into
said established 30 foot setback line shall be per-
mitted on Kirby Drive and the construction of said
overhead canopy to project .8 feet into the established
30 foot setback li:ne--ori Bissonnet Street shall be
permitted, provided however, that any improvements
'placed on the aforesaid tract of land shall in all
other things comply with the existing ordinances and
the Building Code of the City of West University

Section 4. This Ordinance shall take effect and be in force
immediately from and after its passage and approvaL~
