HomeMy WebLinkAboutORD 1452 - ORD Amending ORD 1412 Approved Budget ORDINANCE NUMBER 1452 AN ORDINANCE AMENDING ORDINANCE NUMBER 141 WHICH APPROVED THE BUDGET OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1992, AND ADOPTED ON NOVEMBER 25, 1991; CONTAINING FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS, as provided in the City Charter, the City Council is authorized to transfer moneys within budgeted funds, and the City Council is also authorized to make emergency appropriations to meet pressing needs for public expenditures in order to protect public health, safety and welfare; and WHEREAS, THE City Council desires to amend the current r's budget in to effect such transfers and to reflect such emergency appropri ons; and WHEREAS, the City Council finds and determines t~1at all of such changes in the budget are made for municipal purposes, as allowed by state 1 aw; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: on 1. That the budget of the City of West University Place for the 12-month period beginning January 1,1992, and ending December 31, 1992 as heretofore adopted be, and it is hereby, amended for additional expenditures and revenues, from the Capital Projects Fund as shown by the following schedule: Additional Expenditures - Capital Projects Fund Charlotte/Lake Project $ 215,000.00 Expenditures Original Total Budget Amended Total Budget $ 2,318,050.00 2,533,050.00 12,690,000.00 14,085,235.00 Original Total Capital Projects Fund Amended Total Capital Projects Fund . . ..... .... .._. .. a. Ordinance No. 1452 Section 2. ADDITIONAL INCOME. The City Council hereby determines it advisable to amend such budget to increase the total expenditure and also increase the total anticipated income so that the total means of financing the budget shall equal in amount the aggregate proposed expenditures. The revenue accounts and available cash of the Capital Projects Fund is amended by adding the amounts shown by the following schedule: Additional Revenue and Income - Capital Projects Fund Bond Proceeds $ 5,000,000.00 Revenues Original Total Capital Projects Fund Amended Total Capital Projects Fund Original Total Budget Revenue and Income Amended Total Budget Revenue and Income $ 2,318,050.00 7,318,050.00 12,690,000.00 18,870,235.00 Section 3. The City Council approves, adopts and ratifies the findings set out in the preamble hereof and directs that the City Secretary file a copy of this ordinance with the county clerk, 1n the same manner as original budgets are required to be filed. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstance shall not be affected hereby. Section 5. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 6. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, cons i dered or acted upon was g1 ven 1 n the manner requi red by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Sect10n 7. The pub11c importance of this measure and the requirements of the law create an emergency and an urgent public necessity requiring that this Ordinance be passed and take effect as an emergency measure, and a state of emergency is hereby declared, and this Ordinance is accordingly passed as an emergency measure and shall take t and be in signature.
