ORDINANCE NO. 1422
AN ORDINANCE RELATING TO ELECTRICITY AND ELECTRICIANS:
AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, the City Council desires to update Chapter 8 of
the Code of Ordinances with respect to regulation of
electricians; and
WHEREAS, such an updating will make the regulation of
electricians more effective, thus advancing the primary purpose
of Chapter 8, which is to help protect against hazards related
to electricity;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
Section 1. Sections 8-126 through 8-129 of the Code of
Ordinances of the City of West University Place, Texas, are
hereby amended to read in their entirety as follows:
Sec. 8-126. Examination of electricians.
(a) Each applicant for any classification of
electrician's license must pass an examination prescribed or
approved by the electrical board. The examination shall test
the applicant's knowledge of the City's codes and ordinances as
well as standards for safe and effective electrical work. The
electrical board may: (i) prescribe or approve a standard
examination given by another jurisdiction or testing agency,
(ii) set the passing score, and (iii) waive the requirement
for an examination in the case of an applicant holding a current
and valid, active or inactive, license from the City of Houston,
Texas, of the equivalent class.
(b) Examlnat10ns shall be held quarterly or at such
other reasonable interval designated or approved by the
electrical board.
Sec. 8-127. Re-examination, frequency.
Any applicant who fails an examination the first time
shall be allowed to take a second examination at the next
opportunity. After the second or subsequent failure, an
applicant must wait at least six (6) months for the third
examination, an additional twelve (12) months for the fourth
examination, and an additional twelve (12) months between any
additional examinations after the fourth failure.

Sec. 8-128. Experlence Required.
(a) An applicant for a license as a master
electrician, outside electrician or electrical sign contractor
must have had four (4) years active and practical experience as
a journeyman or maintenance electrician, during which period the
applicant must have devoted not less than two-thirds of his or
her time, exclusive of normal periods of rest and recreation, to
electrical work as a journeyman or maintenance electrician. For
the purposes of this requirement, a degree or diploma from an
accredited school of electrical engineering shall be considered
as the equivalent of two (2) years active and practical
experience.
(b) An applicant for a license as a journeyman
electrician or a maintenance electrician must have had four (4)
years active and practical experience, during which period the
applicant must have devoted not less than two-thirds of his or

electrical work in general. For the purposes of this
requirement, a degree or diploma from an accredited school of
electrical engineering shall be considered as the equivalent of
two (2) years active and practical experience.
(c) There is no experience required for an apprentice
electrician.
Sec. 8-129. Insurance.
Applicants for licenses as master electricians, outside
electricians or electrical sign contractors must meet the
requirements for insurance imposed by Section 6-2 of this Code
for contractor's registrations.

Section 2. The Code of Ordinances of the City of West
University Place, Texas is hereby amended by adding thereto
three new sections to be numbered Section 8-133, 8-134 and
8-135, which new sections read in their entirety as follows:
Sec. 8-133. Fees, Renewal.
(a) An examination fee shall be charged in the amount
set by the City Council. In case of examinations given by
another jurisdiction or testing agency, the applicant shall pay
the applicable fees directly to the jurisdiction or agency.
(b) Before any license or certificate 1s granted or
renewed, the applicable fees prescribed by the City Council must
be paid.
(c) A license or certificate shall be renewed upon
application and payment of the renewal fee, unless it has lapsed
for 90 days or longer, in which case the application,
examination, etc. for a new license are required.
Sec. 8-134. Contents of Applications, licenses and
Certificates.
The electrical board shall prescribe the form and contents
of applications, licenses and certificates for electricians, and
the board may require the applicant to furnish photographs and
other applicable information. The applicant shall promptly
notify the board of any changes in the information so furnished
and shall apply for and obtain a new license or certificate in
such circumstances (unless otherwise prescribed by the board).
Sec. 8-135. Display, Possession of Licenses,
Certificates.
Each holder of an electrician's license or certificate
shall keep it on (or about) his or her person while performing
any act for which it is required and shall show it to any
representative of the City who asks to see it.
Section 3. The Code of Ordinances of the City of West
University Place, Texas is hereby amended by repealing certain
sections indicated below (the sections indicated as "not
changedP shall continue in the Code unchanged):

Section 4. All ordinances and parts of ordinances in
conflict herewith are hereby repealed to the extent of the
conflict only.
Section 5. If any word, phrase, clause, sentence,
paragraph, section or other part of this ordinance or the
application thereof to any person or circumstance, shall ever be

held to be invalid or unconstitutional by any court of competent
jurisdiction, the remainder of this ordinance and the
application of such word, phrase, clause, sentence, paragraph,
section or other part of this ordinance to any other persons or
circumstances shall not be affected thereby.
Section 6. The City Council officially flnds, determines
and declares that a sufficient written notice of the date, hour,
place and subject of each meeting at which this ordinance was
discussed, considered or acted upon was given in the manner
required by the Open Meetings law, TEX. REV. CIV. STAT.
ANN. art. 6252-17, as amended, and that each such meeting has
been open to the public as required by law at all times during
such discussion, consideration and action. The City Council
ratifies, approves and confirms such notices and the contents
and posting thereof.
Section 7. This ordinance shall become effective
immediately upon adoption and signature.
