ORDINANCE

ORDINANCE RELATING TO ALARM SYSTEMS; AMENDING THE
CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS
RELATI TO THE SUBJECT.
WHEREAS, the te Legislature has adopted a new Chapter
218 of the Texas Local Government Code, which new chapter
restricts certain aspects of the regulation alarm systems;
WHEREAS, The Ci Council sires to update Chapter 6 of
the Code of Ordinances in order to conform to the new Chapter
218; and
WHEREAS, certain changes in fees mandated by said new
Chapter 218 are reflected in the new fee schedule adopted at or
t the same time as this ordinance;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
Section 1. The finition of "False alarmll appearing in

emergency or threat of emergency of the kind for which the
alarm system was designed to give notice; provided. a
false alarm is not considered to have occurred unless a
response is made by the police department or other agency
of the City within 30 minutes of the alarm notification
and the department or other agency determines from an
inspection of the interior or exterior of_the premises
that the alarm was false.

(c) Subsection "(a)11 of Section 6..392 of the Code of
Ordinances of the City of West University Place, Texas is hereby
amended to read as follows:
(a) The chief of police may revoke or suspend a permit
under the same rules. regulations and standards applicable to
building permits. In addition, the chief of police may revoke
or suspend a permit for an alarm system if the police department
responds to eleven (11) or more alarm activations within a
singl year for which the responding officers find no proof of
an emergency of the type the alarm was designed to signal
regardless of the reason or cause of such alarm activations.

not affect responses to alarms received.
Section 4. All ordinances and parts of ordinances in
conflict herewith are hereby repealed to the extent of the
conflict only.
Section 5. If any word, phrase, clause, sentence,
paragraph, section or other part of this ordinance or the
application thereof to any person or circumstance, shall ever be
held to be invalid or unconstitutional by any court of competent
jurisdiction, the remainder of this ordinance and the
application of such word, phrase, clause, sentence, paragraph,
section or other part of this ordinance to any other persons or
circumstances shall not be affected thereby.
Section 6. The City Council officially finds, determines
and declares that a sufficient written notice of the date, hour,
place and subject of each meeting at which this ordinance was
discussed, considered or acted upon was given in the manner
required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN.
art. 6252-17, as amended, and that each such meeting has been
open to the public as required by law at all times during such
discussion, consideration and action. The City Council
ratifies, approves and confirms such notices and the contents
and posting thereof.
Section 7. This ordinance shall become effective
immediately upon adoption and signature.
