ORDINANCE NUMBER 1415
AN ORDINANCE AMENDING THE 1991 FISCAL YEAR BUDGET
OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; CONTAINING
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING EMERGENCY.
WHEREAS, as provided in the City Charter, the City Council is
authorized to transfer moneys within budgeted funds, and the City
Council is also authorized to make emergency appropriations to meet
pressing needs for public expenditures in order to protect the public
health, safety and welfare; and
WHEREAS, THE City Council desires to amend the current year's
budget into effect such transfers and to refl ect such emergency
appropriations; and
WHEREAS, the City Council finds and determines that all of such
changes in the budget are made for municipal purposes, as allowed by
state law,
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS:
Section 1. That Expenditures (Account Number 04-50-00-3053)
within the Water Sewer Fund are increased from $62,350.00 to $72,850.00.
Section 2. That Total Water Sewer Fund Expenditures are increased
from $2,349.580.00 to $2,360,080.00.
Section 3. That Total Budget Expenditures are increased from
$17,191,300.00 to $17,201,800.00.
Section 4. That Revenue and Income (Account Number 04-99-00-0590)
in the Water Sewer Fund is increased from $1,192,150.00 to
$1,202,650.00.
Section 5. That Total Water Sewer Fund Revenue and Income is
increased from $2,349,580.00 to $2,360,080.00.
Section 6. That Total Budget Revenue and Income is increased from
$17,191,300.00 to $17,201,800.00.
Section 7. The City Council approves, adopts and ratifles the
findings set out in the preamble hereof and directs that the City
Secretary file a copy of this ordinance with the county clerk, in the
same manner as original budgets are required to be filed.

Section 8. If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance or the application thereof to
any person or circumstance, shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction, the remainder
of this ordinance and the application of such word, phrase, clause,
sentence, paragraph, section or other part of this ordinance to any
other persons or circumstance shall not be affected hereby.
Section g. All ordinances and parts of ordinances in confl ict
herewith are hereby repealed to the extent of the conflict only.
Section 10. The City Council officially finds, determines and
declares that a sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed,
considered or acted upon was given in the manner required by the Open
Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and
that each such meeting has been open to the public as required by law
at all times during such discussion, consideration and action. The
City Council ratifies, approves and confirms such notices and the
contents and posting thereof.
Section 11. The public importance of this measure and the
reqUirements of the law create an emergency and an urgent public
necessity requiring that this Ordinance be passed and take effect as an
emergency measure, and a state of emergency is hereby declared, and
this Ordinance is accordingly passed as an emergency measure and shall
take effect and be in force immediately from and after its passage and
signature.
