ORDINANCE NUMBER 1387
AN ORDINANCE AMENDING ORDINANCE NUMBER 1357 WHICH
APPROVED THE BUDGET OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS FOR THE FISCAL YEAR BEGINNING JANUARY
1, 1990, ANDADOPTED~ON NOVEMBER 13",1989; CONTAINING
FI~DINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING AN EMERGENCY. "
WHEREAS, as provided in: the City Charter, the, City Council is
authorized to 'transfer moneys within budgeted funds, and the City
Counc ili s also authorized to makeeme,rgenc:}' 'appropri ati onsto meet
pressing needs for publ ic expenditures ""in- order to protect the public
health,' safety and welfare; and
WHEREAS, THE City Coun<:.jl _d~sires to amend the current year's

Section 1. That the budget of the City of West University Place
for the 12-monthperiodbeginning January 1,,1990, .andendJng December

Section 2. ADDITIONAL INCOMLTheCity Council hereby determines
it advisable to a~en~ such budget to increase th~ total expenditure and
also increase the total antieipated income so that the total means of
. financing the budget shall, equal in amount the aggregate proposed
expenditures. The revenue accounts and available cash of the General
Fund and Water Sewer Fund are amended by adding the, amounts shown by
the following schedule:

Section 3. The City Counci 1 approves, adopts and ratifies the
findings set out in the preamble hereof and directs that the City
Secretary file a copy of this ordinance with the county clerk, in the
same manner as original budgets are required to be fil~d:
Section 4. If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance or the application thereof to
any person'Or:circumstance, shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction, the remainder
of this ordinance and the application of such word, phrase, clause,
sentence, paragraph, section or other part of this ordinance to any
other persons or circumstance shall not be affected hereby.
Section' 5. All ordinances and parts of ordinances in confl ict
herewith are hereby repealed to the extent of the conflict only.
Section 6. The City Council officially finds, determines and
declares that a sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed,
considered or acted upon was given in the manner required by the Open
Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and
that each such meeting has been open to the public as required by law
at all times during such discussion, consideration and action. The
City Council ratifies, approves and confirms such notices and the
contents and posting thereof.
Section 7. The public importance of this measure and the
requirements of the law create an emergency and an urgent public
necessity requiring that this Ordinance be passed and take effect as an
emergency measure, and a state of emergency is hereby decl ared, and
this Ordinance is accordingly passed as an emergency measure and shall
take effect and be in force immediately from and after its passage and
signature.
