ORDINANCE NUMBER 1380 AN ORDINANCE ESTABLISHING AND REESTABLISHING FEES AND' CHARGES FOR ACTIVITIES, GOODS AND SERVICES PROVIDED BY THE CITY; AMENDING ORDINANCE NUMBER 1366 ADOPTED MARCH 12, 1990; CONTAINING A PROVISION' ~O AUTHORIZE THE CITY MANAGER TO ESTABLISH FEES AND CHARGES IN CERTAIN CIRCUMSTANCES; CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE SUBJECT. , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. The City Council does hereby establish and reestablish the fees and charges shown in the attached Exhibit A, which is hereby incorporated into this ordinance by this reference for all purposes. The fee schedule adopted March 12, 1990, is hereby amended in its entirety by this new fee schedule. Secti on 2. Each of the fees and charges shown in the attached Exhibit A shall take effect immediately upon passage and approval of this ordinance. Section 3. In the case of any activity, goods or services provided by the City for which there is an out-of-pocket cost to the City, or for which a fee or charge has traditionally been collected, the City Manager is authorized to establish and reestablish fees and charges, but only in those circumstances in which a fee or a charge is not prescribed in Exhibit A to this ordinance. In prescribing fees and charges, the City Manager shall first determine the cost to the City of providing the activity, goods or services, and the fees or charges established shall be as equivalent as practicable to such cost. Secti on 4. All ordi nances and parts of ordi nances in confl i ct herewith are hereby repealed to the extent of the conflict only. Section 5. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, secti on or other part of_ thi s ordi nance to any other persons or circumstances shall not be affected thereby. Section 6. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open 268 'I I ; ~ J l ~ Ordinance Number 1380 [ 283 Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 7. This ordinance becomes effective immediately upon adoption and signature. These facilities have been installed to serve lots 7A, 78, 8A, 8B, 9A and 9B, Block 26, West University Place, according to the dedic.ation thereof in Volume 444, Page 560 of the Deed Records of Harris County Texas and Volume 9, Page 13 of the Map Records of Harris County, Texas (these lots ar.e referred to collectively as the "Development Area")., The facilities were "oversized" such that they have the capacity to serve additional lots South of the Development Area, the additional lots being Lots 10 and 11 of said Block 26. Lots ,10 and 11 were both apparently 100 feet .in width originally, but it appears that they may have been subdivided into four lots (lOA, lOB, 11A and lIB), each 50 feet wide. The fee corresponds to the costs of.includingexcess capacity to serve more ar.ea than just _the Development Ar.ea. , The fee does not cover any cost of providing streets or utility lines along the frontage of the lots served. The fee is payable as a condition of the City taking certain actions, but only if such actions are taken on or before March 3, 1996. The fee is payable, in one lump sum, if the City: (i) Constructs (or grants another party the right to construct) a southerly extension of the Street Facilities, to serve Lot lOA, lOB, 11A or lIB, but only if access.to,the extension required the use of the Street facilities and there is not other link to other public streets in the City; (ii) Allows another party to receive water service on one of the lots described above from a southerly extension of the Water Facilities, but only if all water to be provided_is to be conveyed through the Water Facilities; or j (iii) Allows another party to receive sewer service on one of the lots described above from a southerly extension of the Sewer Facilities, but only if all sewage to be collected is conveyed through the Sewer Facilities. For example, the second annual payment shall be due on the first day after the first anniversary of the date this ordinance is finally adopted. Each payment shall be made at the principal office of the City, without demand, on or before its due date. This franchise shall take effect and continue and remain in effect for a period endi,ng at noon on the tenth anniversary of the date this ordinance is adopted finally (unless sooner terminated), provided that this ordinance shall not take effect unless Grantee files a written acceptance of this ordinance with the City Secretary of the City on or before the tenth day following the day that this ordinance is finally adopted (or within such longer period of time as the City Council of the City may prescribe) and makes the i'nitial payment when due. This franchise shall automatically terminate (sooner than the tenth anniversary of the date this ordinance is adopted finally) if that certain lease between The Donald Realty Co., Inc., and Weslayan Bank N.A., dated February 9, 1987, is terminated or is no longer in effect for any reason.
