HomeMy WebLinkAboutORD 1379 - ORD Relating to Muncipal Court Designating Divisions and Terms of Office 25H ORDINANCE NUMBER 1379 AN ORDINANCE RELATING, TO THE MUNICIPAL COURT; DESIGNATING DIVISIONS AND TERMS OF OFFICE; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; APPOINTING AND REAPPOINTING JUDGES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. Section 14-3 (relating to "office of the judge") of the Code Of Ordinances of the City of West University Place, Texas is hereby amended to read as follows: Sec. 14-3. Organization; Divisions. (a) The municipal court is divided into three divisions: Division 1, Division 2 and Division 3. (b) The office of presiding judge of the municipal court is hereby created. The presiding judge shall preside over Division 1. (c) The offices of Associate Judge, Division 2 and Associate Judge, Division 3 are hereby created. Each associate judge shall preside over the indicated division. (d) Each judge shall be a magistrate and shall have all of the powers and authority prescribed by state 1 aw and the Charter and ordi nances of the Ci ty.,' Each judge shall have ,the duti es pertainfn'g to the office of judge. (e) Each division has successive two-year terms of office beginning on September 1 of each odd-numbered calendar year and extending through August 31 of the next following odd-numbered calendar year. Each judge appointed shall serve for the specific term, or the unexpired portion thereof, of the division to which the' judge is appointed. Judges shall also serve after the expiration of their terms of office until their ;successors are appointed and shall have qualified. Removal of judges shall be governed by state law and the City Charter. (f) The municipal court clerk shall serve as' clerk for all divisions, with the assistance of deputy clerks 'as needed. Ordinance Number 1379 280 1 ~ (g) The presiding judge of the municipal court is authorized: (i) to transfer cases between divisions, (it) to approve an exchange of ,benches and to designate which judge shall preside over whichdivis,ion for any given session, and (iit) to establish and maintain a system for filing of complaints with the municipal court clerk so that the case load is equally distributed among the divisions. (h) There are hereby and ass i stant prosecutor. prosecutors, shall serve authority. Section 2. The following persons are appointed and reappointed to the indicated divisions of the Municipal Court of the ,City of West University Place, Texas for the unexpired portions of the terms ending August 31,1991: created the offices of chief prosecutor There shall be two assistants. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the appl ication' thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other, part of this ordinance to any other persons or circumstances shall not be affected thereby. Section 5. The City Council officially. finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance, was discussed, considered or acted upon Was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves ,and confirms such notices and the contents and posting thereof. Section 6. The public importance of this measure and the requirements of the law create an emergency and an urgent public necessity requiring that this Ordinance be passed and take effect as an ~--. I i I I '~ n n l~1 Ordinance Number 1379 261 emergency measure, and a state of emergency is hereby declared, and this Ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage and signature.
