AN ORDINANCE CALLING A JOINT PUBLIC HEARING BEFORE THE
ZONING & PLANNING COMMISSION AND THE CITY COUNCIL IN
RELATION TO THE ZONING ORDINANCE OF THE CITY; PRESCRIBING
AND APPROVING THE TYPE OF NOTICE TO BE GIVEN AND THE FORM
OF NOTICE; CONTAINING FINDINGS AND PROVISIONS RELATING TO
THE SUBJECT AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE TEXAS:
Section 1. There is hereby called a joint public hearing before
the Zoning & Planning Commission and the City Council of the City of
West University Place, Texas. Such public hearing shall be held in the
Community Building at the intersection of Auden Street and Rice
Boulevard beginning at 7:00 o'clock p.m. on September 18, 1990. Such
hearing may be adjourned or recessed from time to time and from place
to place.

Section 2. The purpose of such hearing is to provide an
opportunity for parties in interest and citizens to be heard in
relation to a proposed adoption and readoption of the City's existing
zoning ordinance (lIzoning ordinancell), with miscellaneous amendments
and zoning district boundary changes as follows:
Miscellaneous Amendments
(1) Simplyfying and conforming the graphics on the zoning
district map by: (1) eliminating horizontal and vertical stripe
designations of City and school facilities in the SF District, (2)
eliminating shading of other areas in the SF District, except
where necessary to indicate the appl icabi 1 ity of specific
ordinances or other measures affecting specific sites, (3)
eliminating internal division lines in the SF District around
areas designated by horizontal stripes, vertical stripes or
shading, and (4) adding a dot pattern to conform the boundaries of
the PDD-TH1 District (Bellaire Townhouse P.D.D.) to its correct
boundaries, including the building sites fronting on Bellaire
Boulevard between Mercer Street and the city limits of the City of
Southside Place.
(2) Conforming the zoning, ordinance to, state, _ legislation,
including references to the new Local Government, Code and the
Penal Code.

(3) Clarification of the method of applying height limits.
(4) Amendment of the side street. setback regulations for corner
building sites.
(5) Clarification of regulations restricting use of building
sites for residential purposes.

(6) Clarification and changes to the definition of "sign" and
sign regulations.
(7) Additional restrictions on small construction signs and small
real estate signs.
(8) Clarification of the definition of "subdivided lot."
(9) Changes in the regulations governing the realignment of
subdivided lot boundaries.
(10) Various changes in special setback regulations, including
cross-referencing and regulations relating to garage space and
building lines.
(11) Adopting eXisting Code of Ordinance regulations affecting
qualified trees and conforming the zoning ordinance thereto.
(12) Greater restrictions and clarifications relating to driveways.
(13) Clarification of the procedures for consideration of planned
development districts.
(14) Changes to regulations relating to parking areas.
(15) Clarification of a special regulation
non-conformities involving side setback regulations.
(16) Various amendments to the Projection Schedule which regulates
the projection of structures into setback areas.

(18) Amendments to clarify the regulations for single-family
(detached) uses in non-SF districts.
(19) Clarifications to the regulations involving accessory
structures and accessory uses.
(20) Additional regulations involving sexually oriented businesses.
(21) Changes in the special regulations governing minimum size of
building sites.
(22) Changes in the regulations affecting building space in rear
setback areas and accessory quarters.
Zoning District Boundary Changes.
, (a) Changes to the zoni ng di s tri ct map in the block bounded by
Kirby Drive, Plumb Street, Lake Street and Tangley Street to
accomp 1 ish the fo 11 owi ng: (1) change the zoni ng di stri ct for the
building sites in this block which adjoin Kirby Drive and which

are now predominantly used for commercial purposes from PDD-TH2
(Kirby Drive Townhouse P.D.D.) to C (Commercial District) and (2)
change the zoni ng di stri ct for those porti ons of the bui 1 di ng
sites in this block which adjoin Lake Street and which are now
included in the Commercial District from C (Commercial District)
to SF (Single-Family District).
(b) Change the zoning district for the "JMH No. 3 Site" from C
(Commercial District) to SF (Single-Family District). This site
is 1 oca ted on the south side of Mi lton Street wes t of Co 11 ege
Street (also known as Lots 5, 6, 7 8, and 9 of Block 20 of the
College View, Third Addition, City of West University Place,
Harris County, Texas) ,
(c) Change the zoning district of the "Eastern Star Temple Site"
from SF (Single-Family District, with a special use, designation
for temple use) to PDD-TH4 (Weslayan Townhouse P.D.D.) This site
is located along the south side of, Bissonnet Street, east of
Academy Street, and it is bounded by the existing Weslayan
Townhouse P.D.D. on the East and Browning Street on the South.
This site is sometimes known as 4002 Browning Street, Houston,
Texas 77005.
Section 3. Such proposed amendments have been submitted and are
hereby resubmitted to the Zoning & Planning Commission for its
consideration.
Section 4. (a') The City staff ,is hereby authorized to give notice
of such hearing. The notice shall include the date, time, place and
subject of the hearing, and it shall be in substantially the following
form:

Notice is hereby given that a joint public hearing will

77005.

(b) The notice shall be published at least once in a newspaper of
general circulation in the City at least 15 days prior to the date set
for the hearing. Such notice shall also be sent to all utility
ratepayers in the City (as shown in the City's most current ratepayer
list as of August 1,1990) by depositing the same, properly addressed
and postage prepaid, in a local post office on or before the tenth day
prior to the date set for the hearing (which notices may be included in
the IICity Currentsll newsletter, on the utility bills themselves or on a
separate document). Such a notice shall also be sent to owners of real
property within 200 feet of any property on which a change in zoning
district boundaries is proposed, as such owners are shown on the last
approved City tax roll, by depositing the same in the United States
Mail, in the City, properly addressed with postage paid, on or before
the eleventh day preceding the date set for the hearing.

(c) The notice provisions of this section shall be in lieu of any I
other noti ce requi red by the Texas Local Government Code, as amended, . I
or by any other statute or ordinance. ~
Section 5. The City staff is authorized to make all necessary
arrangements for said hearing and to assist the Zoning & Planning
Commission and the City Council in connection therewith.
Section 6. If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance, or the application thereof to
any person or circumstance, shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction, the remainder
of this ordinance and the application of such word, phrase, clause,
sentence, paragraph, section or other part of this ordinance to any
other persons or circumstances shall not be affected thereby.
Section 7. All ordinances and parts of ordinances in conflict
herewith are hereby repealed to the extent of the conflict only.
Section 8. The City Council officially finds, determines and
declares that sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed,
considered or acted upon was given in the manner required by the Open
Meetings LAW, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended,
and that each such meeting has been open to the public as required by
law at all times during such discussion, consideration and action. The
City Council ratifies, approves and confirms such notices and the
contents and posting thereof.

Section 9. The need to consider the important proposed amendments
and changes at the earliest possible date, with adequate prior notice
being first duly given, creates an emergency requiring the suspension
of the rule requiring the reading of ordinances at two regular meetings
before final passage, and such state of emergency is hereby declared,
and such rule is hereby suspended, so as to allow this ordinance to be
read once, at this meeting, before final passage. This ordinance takes
effect upon its final passage and signature.
