AN ORDINANCE RELATING TO ELECTRICITY; ADOPTI~G HIE ,1990

RELATING TO ELECTRICAL INSPECTORS AND APPEALS; AND
CONTAINING OTHER RELATED FINDINGS AND PROVISIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS:
Section 1. Section 8-16 of the Code of Ordinances of the City of
West University Place, Texas is hereby amended to read in its entirety
as follows:

Sec. 8-16. Adoption.
The National Electrical Code, 1990 Edition ("National
Electrical Code"), as published by the National Fire
Protection Association, is hereby adopted and ordained by
reference and incorporated into this Chapter by reference as
fully and completely as though it were copied herein fully,
but subject to the exceptions stated in this Article. The
National Electrical Code shall be the City's rules and
regulations governing electrical facilities and equipment.
Section 2. Section 8-81 of the Code of Ordinances of the City of
West University Place, Texas is hereby-amended to read in its entirety

Sec. 8-81. Office Established.
The building official shall be the City's chief
electrical inspector. The building official may designate
assistant electrical inspectors from among the employees of
the building inspection division.
Section 3. Section 8-83 of the Code of Ordinances of the City of
West University Place, Texas is hereby amended to read in its entirety
as follows:
Section 8-83. Administration; Enforcement; Etc.

The electrical board has the same authority with respect
to the National Electrical Code as the Building & Standards
Commission has with respect to the Building Code (excluding
quasi judicial enforcement under Subchapter C of Chapter 54
of the Local Government Code, which is within the sole
jurisdiction of the Building & Standards Commission). The
chief electrical inspector has the same authority with
respect to the National El~ctrical Code as the Building
Official, has with respect to the Building Code. Articles I
and II of Chapter 6 of this Code (except Section 6-12) shall

apply to the enforcement and administration of the National
Electrical Code in the same manner that such Articles apply
to the Building Code. In case any provisions of this Chapter
are more restrictive than said Articles, the more restrictive
provisions shall apply. .
Section 4. Subsection (b) of Section 8-146 of the Code of
Ordinances of the City of West University Place, Texas is hereby
amended to read in its entirety as follows:
(b) It is an affirmative defense to a prosecution under
Subsection (a) that: (i) the work in question was performed
completely by a person on his own residence homestead, which
is registered as such with the Harris County Appraisal
District, is occupied by that person and is not offered for
sale, lease or rent, and (ii) that person has demonstrated to
the satisfaction of the chief electrical inspector or his
designee that the work shall be done in compliance with all
applicable ordinances.
Section 5. All ordinances and parts of ordinances in conflict
herewith are hereby repealed to the extent of the conflict only.

Section 6. If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance or the application thereof to
any person or circumstance, shall ever be held to be invalid or =
unconstitutional by any court of competent jurisdiction, the remainder
of this ordinance and the application of such word, phrase, clause, ,
sentence, paragraph, section or other part of this ordinance to any
other persons or circumstances shall not be affected thereby.
Section 7. The City Council officially finds, determines and
declares that a sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed,
considered or acted upon was given in the manner required by the Open
Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended,
and that each such meeting has been open to the public as required by
law at all times during such discussion, consideration and action. The
City Cduncil ratifies, approves and confirms such notices and the
contents and posting thereof.
Section 8. This ordinance takes effect on the tenth day following
its publication, as required by Section 2.12 of the City Charter.
