I --J AN ORDINANCE RELATING TO FENCES; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE TO PROVIDE FOR HOUSE PROJECTIONS AND GATES; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That the Code of Ordinances of the City of West University Place, Texas is hereby amended by adding to Section 6-134 thereof two new subsections, to be numbered (c) and (d), which two subsections shall read in their entirety as follows: (c) A house projection which meets all of the following criteria is not subject to the foregoing height restrictions in this section: (i) the house projection is constructed at the same time as a principal building used for single-family residential purposes, using the same materials, (ii) the house projection is attached to such building, (iii) no part of the house projection is further than 75 inches from a load-bearing wall of such building, (iv) no part of such house projection is taller than eight feet, (v) no part of such house projection is thicker than 12 inches, except for supporting posts, or pilasters, which have a total thickness not greater than 24 inches, including the house projection's thickness, (vi) the house projection complies with all setback requirements and all other provisions of the ordinances of the City, as if the house projection were part of a principal building, (vii) the house projection complies with all other sections of this article. A house projection may connect to a fence or wall which complies with all sections of this article. i ! (d) A gate may be no taller than may a fence or wall at the same location, except that a gate which is not more than 40% opaque may extend to a height not greater than 12 inches above the maximum height of a fence or wall at the same location. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence. paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. The C ty Council officially finds, determines and declares that a suffic ~nt written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices anll the contents and posting thereof. Section 5. This ordinance shall become effective immediately upon adoption and signature. This ordinance shall apply to any house projections constructed on or after March 1, 1988 and to all gates whenever constructed. PASSED AND APPROVED ON FIRST READING, this 22nd day of August , 1988.
