HomeMy WebLinkAboutORD 1325 - ORD Relating to Street Design & Traffic Control, Providing Installation & Maintenance 131 o ORDINANCE NUMBER 1325 AN ORDINANCE RELATING TO STREET DESIGN AND TRAFFIC CONTROL; PROVIDING FOR INSTALLATION AND MAINTENANCE OF CERTAIN STREET AMENITIES AND TRAFFIC DIVERSION DEVICES; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATED TO THE SUBJECT. WHEREAS, the City Council of the City of West University Place, Texas desires to establish standard provisions for the design and installation of traffic diversion devices at those locations where the overall level of traffic safety would be improved by such facilities, and the City Council also desires to provide for certain street amenities as authorized by state law; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That the Code of Ordinances, City of West University Place, Texas, is hereby amended by adding two new sections, to be numbered 13-106 and 19-91, which said sections read as follows: ~! J Sec. 13-106. Traffic Diversion Devices (a) The traffic control officer, with the approval of the City Council, may place and maintain traffic diversion devices at those locations where, in the judgment of the officer, the overall level of traffic safety would be improved by such devices. Such devices may be designed to require that traffic make a certain designated turn or that through traffic not be a 11 owed upon or over certa i n streets, and they may be designed in such a way that they apply to pedestrians and vehicles or only to certain classes of traffic such as motor vehicles. (b) Traffic diversion devices may include curbs, lane indica- tions, signs, railings and:other such facilities,. EJtber the traffic control officer or the City Council may seek public comment on a proposed installation of traffic diversion devices, if such comment would be helpful to the matter under consideration. (c) The City Manager may direct that other departments of the City assist the traffic control officer in connection with the consideration, installation or maintenance of traffic diversion devices. o (d) Traffic diversion devices may be installed in coordination with public conveniences and amenities as authorized by Chapter 19 of this Code. Neither the installation and maintenance of traffic diversion devices nor the installation of public conveniences and street amenities shall ever be construed to work an abandonment or relinquishment of any street or public place. The public conveniences and amenities authorized by Subdivisions (1) and (5) of Section 2 of art. 1085c TEX. REV. CIV. STAT. ANN. may be established and maintained with City funds, materials, equipment and personnel, if approved by the City Council. The City Manager is designated to make the findings required by Section 3 of said statute. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. II , , ; i ~j Section 5. This ordinance becomes effective immediately upon adoption and signature.
