HomeMy WebLinkAboutORD 1309 - ORD Amending Code of Ord of West U Adopting 1987 Edition of the National Electrical Code 26 ORDINANCE NUMBER 1309 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; ADOPTING THE 1987 EDITIO.N OF THE NATIONAL ELECTRICAL CODE; PROVIDING AN 'EFFECTIVE DATE AND CONTAINING FINDINGS AND RELATED PROVISIONS. l '----' BE IT ORDAINED BY THE CITY tOUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That Section 8-16 of the Code of Ordinances of the City of West University Place, Texas, is hereby amended to read as f 011 ows : Section 8-16. Adoption. There is hereby adopted by the city and declared operative therein for the purpose of establishing rules and regulations for the erection, construction, alteration, repair, removal, conversion and maintenance of electrical facilitie$, installations and equipment in homes, buildings and other installations, and for the issuance of permits, collections of fees therefor, and the making of inspections thereof, the National Electrical Code, 1987 Edition, as published by the National Fire Protection Association, of which not less than three copies have been and are now on file in the office of the city secretary, and the same is hereby adopted and incorporated herein as fully as if set out at length herein, and shall be controlling and binding within the city. Section 2. That Section 8-18 of the Code of Ordinances of the City of West University Place, Texas, is hereby amended to read in its entirety as follows: All window air conditioning units, attic fans, washing machines, electric driers, electric water heaters and all other devices or appliances (whether fixed in place or not) drawing 600 watts or more which may be installed or reinstalled in the City shall be s.erviced by an independent or separate electrical circuit for each such appliance or device, and each such circuit must be wired with number 12 or larger conductors. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. j i ~ 27 Ordinance Number 1309 D Section 5. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. ' Section 6. This ordinance takes effect on the tenth day following its publication, as required by Section 2.12 of the City Charter. PASSED AND APPROVED ON FIRST READING this 14th day of December , 1987.
