HomeMy WebLinkAboutORD 1306 - ORD Relating to Genral Penalty for Violations 17 o ORDINANCE NUMBER 1306 AN ORDINANCE RELATING TO GENERAL PENALTY FOR VIOLATIONS AND CONTINUING VIOLATIONS OF THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AMENDING SUCH CODE AND CONTAINING FINDINGS AND RELATED PROVISIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: 11 Section 1. That Section 1-7 of the Code of Ordinances, City of West University Place, Texas, is hereby amended to read as follows: Whenever in this Code or in any ordinance of the city an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such Code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, and no specific penalty is provided therefor, the violation of any such provision of this Code or any such ordinance shall be punished by a fine. No fine shall exceed two thousand dollars ($2,000.00) for viol~tions of all such rules, ordinances and police regulations that govern fire safety, zoning or public health and sanitation, including dumping of refuse nor exceed five hundred dollars ($500.00) for all other violations. No penalty shall be greater or less than the penalty provided for the same or a similar offense under the laws of the state. Each day any violation of this Code or of any ordinance shall continue shall constitute a separate offense. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. 11 Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and act;.on.
