LELAND WINSTON AS MEDICAL DIRECTOR OF THE CITY OF WEST UNIVERSITY PLACE PURSUANT TO ARTICLE 44470 V.T.C.S.; AND PURSUANT TO TEXAS STATE BOARD OF MEDICAL EXAMINERS RULES AND REGULATIONS; PROVIDING FOR A TERM OF OFFICE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council has determined that a Medical Director primarily responsible for the supervision of the City's Emergency Medical Services and the medical portion of such function is required under the above stated Statutes and Rules and Regulations of the Texas State Board of Medical Examiners; and WHEREAS, Section 9.42 of the Code of Ordinances of the City of West University Place created the office of Medical Director to be appointed by the City Council; and WHEREAS, Dr. Leland Winston, a knowledgeable and qualified i i , ) I : ~ physician in this area, has agreed to serve in the capacity of Medical Director; and WHEREAS, compliance with the above stated Statutes and Rules and Regulations requires that this ordinance be passed finally on the date of its introduction. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That Dr. Leland Winston is hereby appointed Medical Director of the City of West University Place pursuant to the requirements of the applicable laws of the State of Texas and the Rules and ReguJations of the Texas State Board of Medical Examiners. That Dr. Winston's appointment shall be for a term of two (2) years from the date of appointment and continuing thereafter until his successor shall have been appointed and shall have qualified. Section 3. Al,l ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or fl LJ unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. Section 5. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. There exists a public emergency requiring that this ordinance be passed finally on the date of its introduction, and the City Council having declared the existence of such emergency and requested such passage, this ordinance shall be passed finally on the date of its introduction, this ~ day of November ,1987, and shall take effect immediately upon its passage and approval.
