ORDINANCE NUMBER 1293
AN ORDINANCE CALLING A JOINT PUBLIC HEARING BEFORE THE
ZONING AND PLANNING COMMISSION AND THE CITY COUNCIL IN
RELAT!ON TO A PROPOSED COMPREHENSIVE REVISION AND AMENDMENT
OF THE ZONING ORDINANCE OF THEGITY OF WEST UNIVERSITY
PLACE; PRESCRIBING THE TYPE OF NOT!CE TO BE GIVEN;
CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS:
Sect ion 1. There is hereby call ed a j oi nt pub 1 i c hea ri ng before
the Zoning and Planning Commission and the City Council of the City of
West University Place, Texas. . Such public hearing shall be held in the
Community Building at Audenand Rice Boulevard beginning at 7:30
o'Clock p.m. on Monday, July 20,1987. 'Such hearing may be adjourned
or recessed from time to time and from place to place.
Section 2. The purpose of such hearing is to provide an
opportunity for parties in interest and citizens to be heard in
relation to a comprehensive revision and amendment of the city's
zoning ordinance, including the zoning district map.

Section 3. Such proposed comprehensive revision and amendment has
been submitted and is hereby resubmitted to the Zoning and Planning
Commission for its consider'ation.: " "
Section 4. The City staff is hereby authorized to prepare and
give notice of such hearing. The form of the notice shall be
substantially as shown in Exhibit A, which is attached hereto and
incorporated herein by this reference. The notice shall be published
at least once in a neWspaper'of gener'al 'circulation in the City at
least 15 days prior to the date set for the hearing. Such a notice
shall also be sent to owners of real property as shown on the last
approved City tax roll, by depositing the same, properly addressed and
postage prepaid, in a local post office at least ten days prior to the
date set for the hearing. The notice provisions of this section shall
be in lieu of any other notice required by TEX. REV. CIV. STAT.
ANN. art. 1011f, as amended, or by any other statute or ordinance.

Section 5'. . The City staff is authorized to make'all ne'cessary
arrangements for said hearing and to assist the Commission and the
Council in connection therewith.

Section 6. If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance, or the application thereof to
any person or circumstance, shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction, the remainder
of this ordinance and the application of such word, phrase, clause,
sentence, paragraph, section or other part of this ordinance to any
other persons or circumstances shall not be affected thereby.

Ordinance Number 1293
Section 7. All ordinances and parts of ordinances in conflict
herewith are hereby repealed to the extent of the conflict only.
Section 8. The City Council officially finds, determines and
declares that sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed,
considered or acted upon was given in the manner required by the Open
Meetings LAW, TEX. REV. CIV.STAT. ANN. art. 6252-17, as amended,
and that each such meeting has been open to the public as required by
law at all times during such discussion, consideration and action. The
City Council ratifies, approves and confirms such notices and the
contents and posting thereof.
Section 9. The need to consider the important proposed revision
and amendment at the earliest possible date, with adequate prior notice
being first duly given, creates an emergency requiring the suspension
of the rule requiring the reading of ordinances at two regular meetings
before final passage, and such state of emergency is hereby declared,
and such rule is hereby suspended, so as to allow this ordinance to be
read once, at this meeting, before final passage.
