HomeMy WebLinkAboutORD 1284 - ORD Canvassing the Returns and Declaring Results of General Election '~) t165 {~ I i I i I ,~j ORDINANCE NUMBER 1284 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE GENERAL ELECTION HELD IN THE CITY OF WEST UNIVERSITY PLACt, TEXAS, ON APRIL 4, 1987, AND CONTAINING RELATED FINDINGS AND PROVISIONS AND DECLARING AN EMERGENCY. , WHEREAS, the City Council of the City of West University Place, Texas, (the "City"), ordained that an election be held in the City on the 4th day of April , 1987, for the purpose of electing a Mayor and four Council Members of said City for a two-year term as prescribed by the City Charter; and WHEREAS, the returns of such election have been duly and legally made and submitted to the City Council of the City for canvassing, and a tabulatton of the returns for each election precinct and for absentee voting, as canvassed and tabulated by the City Council of the City and shown in Exhibit A attached hereto, reflect that the sum of precinct totals>for each candidate as follows: Michael L. Parks Mayor 650 votes Beth Ann Bryan Council Member 597 votes Buddy Bell ' "Counctl"Member 571 votes G. Lynwood Howard Council'Member 228 votes C. Boone Sthwartiel Council 'Member' 565' votes H. L. As a resul~ of such' canvass and tabulation it is hereby U determined that Mike Parks, with a total of 650 votes cast for him, was elected MAYOR of the City of West University Place, Texas; and that I Beth Ann Bryan, with a total number of 597 votes cast for her; and Buddy Bell, with a total number of 571 votes cast for him; and C. Boone Schwartzel, with a total number of 565 votes cast for him; and H. L. Britton with a total number of 578 votes cast for him; have been elected COUNCILMEMBERS of the City of West University Place, Texas. Section 3. The City Secretary is hereby authorized and directed to make the appropriate entries of information appearing in the tabulation of precinct results shown in Exhibit A attached hereto in the election register maintained by the City in accordance with provisions of Section 67.006 of the TEXAS ELECTION CODE. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. Section 5. All ordinances and 'parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 6. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 7. The public importance of this measure and the requirements of the Jaw create an emergency and an urgent public necessity requiring that this Ordinance be passed and take effect as an emergency measure, and a-state of emergency is hereby declared, and this Ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage. 2 o u Councilmembers Voting Aye: PASSED AND APPROVED, this the 6th day of April, 1987.
