HomeMy WebLinkAboutORD 1278 - ORD Calling Joint Public Hearing Before Planning & zoning Commission ~':y... ~, ~1'-41 Ordinance No. 1278 AN ORDINANCE CALLING A JOINT PUBLIC HEARING BEFORE THE PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL IN RELATION TO THE ZONING ORDINANCE OF THE CITY; PRESCRIBING THE TYPE OF NOTICE TO BE GIVEN; CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY tOUNCIL Of THE CITY OF WEST UNIVERSITY PLACE TEXAS: Section 1. There is hereby' called a joint publ ic hearing before the Pl anningand ZoningCommi ssionand the City Council of the City of West University Place, Texas. Such public hearing shall be held in the Community cBui'ldingat Auden ahd Rice Boulevard beginning at 7:30 o'clock p.m.on~:Motiday~ February 23,1987. 'Such hearing may be adjourned or recessed from time to time and from place to place. Section 2. The purpose of such hearing is to provide an opportunity for parties in interest and citizens to be heard in relation to a revision of the City's zoni.ng ordinance, which is generally described below: (a) Establishment or re-establishment of the following districts: m " -, (1 ) (2) " , (3) (4) (5) Co i, .' Such proposed amendments have been submi tted and are hereby resubmitted to the Planning arid Zoning Commission for its consideration. .. , Section 4. The City ,staff is hereby authorized to prepare and give notice of such hearing. The notice shall include the date, time, place and subject of the hearing. 'Thel notice shall be publ ished at least once in a newspaper of general circulation in the City at least 15 days pri or to the date set for the heari ng. Such a noti ce shall also be sent to owners of real propertYI as shown on the last approved City tax roll, by depositing the same, properly addressed and postage prepaid, in a local post office at least, ten ,days prior to the date set for the hearing. The notice provision of this secti onsha 11 be in 1 i eu of any other notice required by TEX. REV. CIV. STAT. ANN. art. 1011f, as amended, or by any other statute or ordinance. Section 5. The City staff is authorized to make all necessary arrangements for said hearing and, to assist the Planning and Zoning Commission in connection therewith. Section 6. If any word, phrase, clause, sentence, paragraph, '):,J section or other part of this ordinance, or the application thereof to any person or circumstance, shall ever ,be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, secti on or other part of thi s ordinance to any other persons or circumstances shall not be affected thereby. Section 7. All ordinances and pa,rts of ordinances in confl ict herewith are hereby repealed to the extent of the conflipt only. <., Section 8. The City Council officially finds, determines and declares that sufficient written notice' of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings LAW, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. u 2 i.:' ;\ 41'4' 3 ~ . . ~ n Section 9. The need to consider the important proposed amendments at the earliest possible date, witha:dequate prior notice being first duly given, creates an emergency reqUfring 'the suspension of the rule requiring the reading of ordinances ' at two regular meetings before final passage, and such state of, emergency i's hereby declared, and such rule is hereby suspended, so as to allow this ordinance to be read once, at this meeting, before final passage.
