ORDINANCE NUMBER 1262
AN ORDINANCE CANVASSING THE RETURNS AND
DECLARING THE RESULTS OF THE BOND ELtCTION
HELD JUNE 21, 1986, AND CONTAINING RELATED
, -".FINDINGS AND, PROVISIONS. "

WHEREAS, the City Council of the City of West University Place,
Texas,' (the "City") ,ordai.n,ed that an;,election ,b~ held in the City on
the 21st day of June, 1986, for the purpose of submitting the following
proposition,for,th,e issuance of bonds to the electors ,of the City, to
wit: '

amount of $4,700,000 for improving,

incidental thereto; such bonds to mature

any price or prices, and to bear interest at
any, rate or rates:. (fixed, floating,
variable, or otherwise) as shall be

Council at the time of issuance or sale of
the bonds; and whether ad valorem taxes
shall be levied upon all taxable property in

interest and provide a sinking fund to pay
the bonds at maturity?"
',WHEREAS, it is hereby found and deterrnined'that noti-ce ot'such '
electlon was duly given in the form, manner,and'time required by law
and that such election was in all respects legally held and conducted
in accordance with the proceedings calling and governing the holding of
such election and with the applicable laws of the State of Texas and
the United States, particularly the TEXAS ELECTION CODE, as amended,
and the Voting Rights Act, as amended, respectively, and the presiding
officer of the City Council has set this time as the time for convening
this meeting, as contemplated by Section 67.003 of the TEXAS ELECTION
CODE; and

WHEREAS, the returns of such election have been duly:andlegally
made and- sUQmitted to the City Council of the City for canvassing, and
a tabulation of the returns for each election precinct and for,absentee
voting, as canvassed and tabulated by the City Council of the City and
shown in Exhibit A attached hereto, reflect that the. sum of precinct
totals "FOR" and "AGAINST" such proposition were as follows:

NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE, THAT:

Section 1: All of the recitals contained in the preamble of this
Ordinance are found to be true and are adopted as findings of fact by
this City Council and as part of its judgment, particularly the results
of the election described' therein as canvassed and tabulated in the
preamble hereof and as shown in, and made a part hereof for all
purposes, Exhibit A attached hereto.
Section 2: A majority of the qualified electors voting at such
election voted in favor of the proposition presented at.such election.
Section 3: The City Council is authorized and empowered to issue
the bonds authorized by such proposition on behalf of the City in the
amount and for the purposes stated in such proposition, all as more
fully set forth: and, identi:f1ied above, and in the proceedings calling
such el ecti'on.
Section 4: T~e City Secretary is hereby authorized and directed
to make the appropriate entries of information appearing in the: ,
tabulation of precinct results shown in Exhibit A attached hereto in
the election register maintained by the City in accordance with
provisions of Section 67.006 of the TEXAS ELECTION CODE.
Section 5: If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance or the application thereof to
any person or circumstance, shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction, the remainder
of this ordinance and the application of such word, phrase, clause,
sentence, paragraph, section or other part of this ordinance to any
other persons or circumstances shall not be affected thereby.
Section 6: All ordinances and parts of ordinances in conflict
herewith are hereby repealed to the extent of the conflict only.

Section 7: The City Council officially finds, determines and .J,l,1
declares that a sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed~
considered or acted upon was given in the manner required by the Open
MeetingsLaw~ TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and
that each such meeting has been open to the public as required by law
at all times during such discussion, consideration and action. The
City Council ratifies, approves and confirms such notices and the
contents and posting thereof.
Section 8: The public importance of this measure and the
requirements of the law create an emergency and an urgent public
necessity requiring that this Ordinance be passed and take effect as an
emergency measure, and a state of'emergencyis hereby declared, and
this Ordinance is accordingly passed, as an emergency measure and shall
take effect and be in force immediately from and after its passage.
