AN ORDINANCE ORDERING A BOND ELECTION TO BE HELD IN THE,CITY OF
WEST UNIVERSITY PLACE, TEXAS, IN: REGARD, TO THE SANITARY SEWER
SYSTEM OF SAID CITY; 'MAKING PROVISION FOR THE CONDUCT OF SUCH
ELECTION; AND ORDAINING OTHER MATTERS INCIDENT AND RELATED TO SUCH
ELECTION.

WHEREAS, the City of ' West Unive-rsity Place, Texas (the "City"), is
authorized by the laws of the State of Texas to issue its bonds, for the
purpose descri bedi n the propos'i ti on herein; .
WHEREAS, such bonds may not be issued until authorized by a
majority vote of the resident electors of the City voting in an
election called for such purpose; and
WHEREAS,.the City Council of the City of West University Place,
Texas (The "City CounciP) hereby finds that an election should be held
to determine whether said governing body shall be authorized to issue
bonds of said City in the amount and for the purpose hereinafter
identified;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS, THAT:

, SECTION 1: An election shall be held on the 21st day of June,
1986, in the City of West University Place, Texas, which date is not
less than fifteen (15) nor more than ninety (90) days from the date of
the adoption hereof, for thepurp0s~ of submitting the following
proposition:
"SHALL the City Council of the City of West University Place,
Texas, be authorized to issue bonds of the City in the principal amount
of $4,700,000 for improving, "extending, replacing, repairing and
rehabilitating the City's Sanitary Sewer System including all matters
necessary or incidental thereto; such bonds to mature serially or,
otherwise over a period not to exceed forty (40) years'from their date,
to be issued and sold in one or more series, at any price or prices,
and to bear interest at any rate or rates (fixed, floating, variable,
or otherwise) as shall be determined within the discretion of the City
Council at the time of issuance or sale of the bonds; and whether ad '
valorem taxes shall be levied upon all taxable property in the City
sufficient to pay the annual interest and provide a sinking fund to pay
the bonds at maturity?"
SECTION 2:

(a) An electronic voting system and punch-card ballots shall be
used for such election and absentee voting shall be by use of paper
ballots .for absentee voting by personal appearance and by mail.

(b) Punch-card ballot~ and punch-card b~llotlabels and absentee
ballots for the election shall be prepared in accordance with the
applicable provisions of the TEXAS ELECTION CODE so that the voters may
cast their ballots either II FOR THE ISSUANCE OF BONDS" or "AGAINST THE
ISSUANCE OF BONDS II with regard to the aforesaid proposition which shall
appear on the ballot substantially as follows:
PROPOSITION
liTHE ISSUANCE OF $4,700,000 OF BONDS FOR IMPROVING,
EXTENDING, REPLACING, REPAIRING AND REHABILITATING THE
SANITARY SEWER SYSTEM OF THE CITY OF WEST UNIVERSITY PLACE,
TEXAS, INCLUDING ALL MATTERS NECESSARY ORTNCIDENTAL THERETO."
(c) The City Council hereby appoints a Presiding Judge, J. T.
Hood, for the Central Counting Station, which for purposes of this
election shall be located at the West University Place City Hall, 3800
University Blvd. Opal McKelvey shall serve as the Manager of the
Centra,l Counting Station ~nd Audrey Nichols as Tabulation Supervisor
for the election.
(d) The City of West University Place shall conduct a test of the
automati c tabul ating equipment on Tuesday, June 17, 1986, at 7: o' c.lock
P.M. in Council Chambers at City Hall, open to the public.

SECTION 3:
(a) The City shall be divided into four (4) election precincts

(b) Said precincts shall be the same as the Harris County voter
pre~incts bearing the same numberS as those ,most recently established
by the Commissioners Court of Harris County, Texas.
(c) Each Presiding Judge shall appoint not less than two (2) and
not more than five (5) qualified clerks to serve and assist at the
polling place under his/her jurisdiction in holding said election;
provided that if any Presiding JudgeJherein appointed actually serves
in holdihg said election~ 'the Alternate, Presiding Judge for the
precinct in question shall be one of the clerks.
(d) On election day, the polls shall be open from 7:00 ,A.M. to
7:00 P.M.

(e) Absentee voting shall be conducted at the City Hall Council
Chamber in the Municipal Building during the hours the City Secretary's
main business office is regularly opened for business, 8:00 a.m. to
5:00 p.m., Monday through Friday, (3800 University Bou.levard,. Houston,
Texas 77005, which shall be the absentee voting clerk's mailing address
to which ballot applications and ballots voted by mail may be sent), in
accordance with the provisions of the TEXAS ELECTION CODE. For
purposes of processing absentee voting results, the precinct election
officers serving Precinct #15 shall serve as the Absentee Ballot Board
for this election.
SECTION 4: All qualified electors of the City shall be permitted
to vote at said election. Not withstanding any provisions to the
contrary in this ordinance, this election shall be held and conducted
in pccordance with the TEXAS ELECTION CODE and Chapter 1 of Title 22,
TEX. REV. CIV. STAT. ANN. and, as may be required by law, all election
materials' and proceedings shall be printed in both. English and Spanish.
SECTION 5: A substantial copy of this Ordinance shall serve as
proper notice of said election. Said notice, including a Spanish
translation thereof, shall be posted at three (3) public places within
the City and at the City Hall not less than fourteen (14) full days l;J~
prior to the date on which said election is to be held, and be
published on the same day in each of two successive weeks in a
newspaper of general circulation in the City, the first of said
publications to appear in said newspaper not more than thirty (30) days

and not less than fourteen (14) full days prior to the day of the
election.
SECTION 6: The Mayor, the Mayor Pro Tern ah~the City Manager, or
any of them, and the City Secretary and the Assistant Secretary, or
either of them, are authorized on behalf of the City Council to
evidence adoption of this Ordinance and to do any and all other things
legal and necessary in connection with the holding and consummation of
such election and to give effect to the intent of this Ordinance.
SECTION 7: If any provision, section, sentence, clause, or phrase
of this Ordinance is held for any reason to be invalid, such invalid
, portion shall not affect the validity of the remaining portions of this
Ordinance.

SECTION 8: If any word, phrase, clause, sentence, paragraph,
section or other part of this ordinance or the application thereof to
any person or circumstance, shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction, the remainder
of this Ordinance and the application of such word, phrase, clause,
sentence, paragraph, secti on or other part of thi s Ordi,nance to any
other persons or circumstances shall not be affected thereby.
SECTION 9: All ordinances and parts of ordinances in conflict
herewith are hereby repealed'to the extent of the conflict only.
SECTION 10: The City Council officially finds, determines and
declares that a sufficient written notice of the date, hour, place and
subject of each meeting at which this ordinance was discussed,
considered or acted upon was given in the manner required by the Open
Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and
that each such meeting has been open to the public as required by law
at all times during such discussion, consideration and action. The
City Council ratifies, approves and confirms such notices and the
contents and posting thereof.

SECTION 11: The public importance of this measure and the fact
that it is in the best interest of the City and its inhabitants to
submit to an election the proposition for the issuance of bonds as
herein set out at the earliest possible date, for the immediate
preservation of the public peace, property, health, and safety of the
citizens of the City of West University Place, Texas, and for the usual
daily operation of a municipal department of said City, (and a state of
emergency is hereby declared) constitute and create an emergency and an
urgent public necessity requiring that this Ordinance be passed and
take effect as an emergency measure, and a state of emergency is hereby
declared, and this Ordinance is accordingly passed as an emergency
measure and shall take effect and be in force immediately from and
after its passage.
