ORDINANCE NUMBER 1221
AN ORDINANCE APPROVING THE ESTIMATE OF THE COST OF THE
IMPROVEMENT OF THE 3800 BLOCK OF CASE STREET, 4200 BLOCK
OF ALBANS STREET AND THE 4200 BLOCK OF EMORY STREET;
ORDERING A HEARING IN CONNECTION WITH ASSESSMENTS PRO-
POSED TO BE LEVIED AGAINST ABUTTING PROPERTY AND THE
OWNERS THEREOF; MAKING FINDINGS AND PROVISIONS RELATING
THERETO; AND DECLARING AN EMERGENCY.
WHEREAS, by Ordinance Number 1219, the Council has determined the
necessity to pave the portions of the above named streets; and
WHEREAS, by Ordinance Number 1220, the Council has awarded the con-
tract for such work to John G. Holland Construction Company; and
WHEREAS, the Council has reviewed the estimate of cost of the im-
provements and are considering assessments of a portion of the cost of such
improvements against abutting property and the owners thereof; and
WHEREAS, a Public Hearing of the owners of the abutting property is
necessary to receive such owners input.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST UNIVERSITY PLACE, TEXAS:
Section 1. In the matter of the permanent improvement of portions
of Case, Albans and Emory Streets, in the City of West University Place, Texas,
as ordered by Ordinance Number 1219, the City Council hereby approves and
adopts the estimate of the cost of the improvements which have been made and
filed with it by the city.s corisulting engineer, as directed in said ordinance,
such estimate being as follows:
See attached Exhibit IIAII made a part hereof for all purposes.
Section 2. The City Council hereby orders that a hearing be held
by and before the City Council of the City of West University Place at 7:30
olclock p.m., on February 20, 1984, in the City Hall, Counci 1 Chambers, 3800
Univer~ity Boulevard, in said city, at which time and place, ail owning any
property abutting upon said portions of said street, or having any interest
therein, shall have the right at such hearing to be heard on any matter to
which the hearing is a constitutional prerequisite tbthe ~alidity of any
assessment authorized by said Act, and to contest the amounts of the proposed
assessments, the lien and liabil ity thereof, the special benefits to the
abutting property and Owners thereof by means of the improvements for which
assessments are to be levied, the accuracy, sufficiency, regularity, and
validity of the proceedings and contract in connection with such improvements
and proposed assessments.
Section 3. Following such hearing, as above provided for, assess-
ments will be levied against said abutting property and the real and true
owners thereof for that portion of the cost of said improvements hereinabove
determined to be payable by said abutting property as the real and true owners
thereof, in the respective amounts as shall be determined at said hearing.

Section 4. The City Secretary is directed to give notice of such
hearing to all owning any property abutting upon said portion of said street
and to all claiming any such property or any interest therein and to all in-
terested in such property. Such notice shall be given by advertisement
inserted at least three (3) times, in the Houston Chronicle, the first publi-
cation to be made at least twenty-one (21) days before the date of the hear-
ing. The City Secretary shall give additional written notice of the hearing
by depositing in the United States mail, at least fourteen (14) days before
the date of the hearing, written notice of such hearing, postage prepaid, in
an envelope addressed to the owners of the respective properties abutting upon
such streets, highway, highways, or portion or portions thereof to be improved,
as the names of such owners are shown on the then current rendered tax rolls
of such city and at the addresses so shown, or if the names of such respective
owners do not appear on such rendered tax rolls, then addressed to such owners
as their nameS are shown on the current unrendered rolls of the city at the
addresses sh0wn thereon. The City Secretary may also send notices to other
names and addresses to the extent considered desirable in order to give ade-
quate notice of such'hearing. The notice to be mailed may consist of a copy
of the published notice.
The City Secretary shall, in such manner and form as she deems suf-
ficient, make and preserVe a record to evidence the following:
(a) The fact and date of the mailing of such notices with a short
description of the project to which the notices so mailed
related; and
(b) The nameS and mailing addresses to which the notices so mailed
were addressed.
From time to time, if supplemental lists of nameS and addresses to
which such notices are desired to be sent are furnished the City Secretary,
she will mail such notices to the nameS and addresses reflected upon such sup-
plemental list or lists, making and 'preserving a like or similar record in con-
nection therewith. The City Secretary will also make and preServe in such
manner and form as she deems sufficient, a record of those, if any, of the
notices so mailed which are returned to her from the Post Office as not having
been delivered and will preServe the envelopes so returned to her.
All records so made by the City Secretary incident to the
mailing hereby ordered of such notices including the return of any thereof to
the City Secretary, shall be public records available for inspection, examina-
tion or copying by any person legitimately interested therein; and copies of
any thereof or of any part or parts of any thereof shall be made and furnished
by the City Secretary to any person desiring the same at the same charges and
fees as those which the City Secretary is authorized to charge for the furnish-
ing of certified copies of ordinances or other papers or documents in her
custody.
Section 5. In such notice, the City Secretary shall describe in
general terms the nature of such improvements for which assessments are pro-
posed to be levied, shall state the streets or highways and the portion thereof
to be improved, shall describe in general terms the nature of such improvements
for which assessments are proposed to be levied, shall state the estimated
amounts per front foot proposed to be assessed against the owners of abutting
property on such portion of such highway and to be assessed against such pro-
perty, and shall state the stimated total cost of such improvements of such
portion of such street or highway. Such description and statements may

consist of a copy of the estimate prepared by the city's consulting engineer as
approved in Section 1 hereof. The notice shall state the time and place at
which such hearing is to be held. There may also be included in such notice
such further data and information regarding such proposed assessments as the
U City Secretary deems proper and such general statement as the City Secretary
1\ deems sufficient to acquaint those to whom it is directed with the fact that
'. ,I,ll' they have a right to be heard and to inform them of the matt~rs upon which
" they are entitled to be heard.
Section 6. There exists a public emergency requiring that this ordi-
nance be passed finally on the date of its lntroduction, and the Mayor having
in writing declared the existence of such emergency and requested such passage,
this ordinance shall be passed finally on the date of its introduction, this
23rd day of January, 1984, and shall take effect immediately upon its passage
and approval by the Mayor.
