HomeMy WebLinkAboutORD 1363 - ORD Relating BUilding Footings and Foundations 147 ffi ORDINANCE NUMBER 1363 AN ORDINANCE RELATING TO BUILDING FOOTINGS AND FOUNDATIONS; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS, the City Council has heretofore adopted Ordinance No. 1356 relating to building footings and foundations, and the City Council desires to amend further the Code of Ordianance provisions relating to building footings and foundations, in response to comments received from an industry'representive; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. Subparagraph (ii) (relating to footings and foundations) of Section 6-52 of the Code of Ordinances of the City of West University Place is hereby amended to read in its entirety as f 011 ows : ' n I I It (ii) All footings and foundations must meet all of the requirements of the Building Code. In addition, all footings and foundations of buildings must be adequately designed for the soil conditions'and must cbntain adequate steel reinforcement (with a minimum reinforcement of 6x6x6 wire mesh).' I I [I ~ Ill..;yll I Ordinance Number 1363 . . ~. correctly tensioned in the presence of, and under the direction and control -of, a registered professional engineer and that the slab'is properly constructed and completed. The Building Official may require that such certificte be made and delivered to the Building Official at any time after the tensioning work is done, but it shall be delivered, in any event, as a condition of receiving a certificate of occupancy. Section 2. This ordinance applies to all building foundations constructed after the date this ordinance becomes effective, except that the special transitional rule stated in Section 2 of Ordinance No. 1356 shall continue to apply to any foundations originally falling within the scope of such transitional rule. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. 148 u Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder ell of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected'thereby. Section 5. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon Was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art~ 6252-17, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 6. The public importance of this measure and the requirements of the law create an emergency and an urgent public necessity requiring that this Ordinance be passed and take effect as an emergency measure, and a state of emergency is hereby declared, and this Ordinance is accordingly passed as an emergency measure and shall take effect on the tenth day following its publication as prescribed by the City Charter.
