TO PREPARE PLANS AND SPECIFICATIONS FOR THE DRILLING OF A WATER WELL AND CONSTRUCTION OF A 12"WATER TRANSMIS- SION LINE; RECITING THE DATE TO RECEIVE BIDS FOR" DRILLING OF A WATER WELL AND CONSTRUCTION OF A 12" WATER TRANSMISSION LINE;'REFERRING BIDS TO LANGFORD 'ENGINEERING,' INC. AND THE DIRECTOR OF PUBLIC WORKS FOR TABULATION AND RECOMMENDATION; APPROPRIATING THE NECESSARY FUNDS IN ORDER TO AWARD A CON- , ' TRACT; APPROVE AND ACCEPT THE CONTRACT, PERFORMANCE BOND AND INSURANCE IN CONNECTION WITH SAID IMPROVEMENTS; AWARD A CONTRACT TO LAYNE-WESTERN COMPANY, P.O. BOX 79060, HOUSTON, TEXAS FOR'DRILLING SAIDWEL~; AWARD A CONTRACT TO JALCO, INC., 3233 WESLAYAN, HOUSTON, TEXAS, FOR CO~STRUCTION OF SAID 12" WATER TRANSMISSION LINE; AND AUTHORIZING EXECUTION THEREOF BY THE MAYOR OF THE CITY'OF WEST UNIVERSITY PLACE, I' TEXAS. ~I-l 11 I I lL WHEREAS, the City Commission has heretofore determined that certain improvements, including a new water well and 12" water transmission line are required to assure an adequate water supply system for the City of West Uni- versity Place; and WHEREAS, on October 23, 1978, the City Commission of the City of West University Place employed' Langford Engineering, Inc. to prepare plans and specifications for~drilling a water well and construction of a 12" water transmission line; and o WHEREAS, plans and specifications prepared by such project by Lang~ ford Engineering, Inc. were accepted and subsequently bids received from three (3) bidders on~December 10,1979, with one bid being rejected for failure to conform to the requirements set forth in the Technical Specifications for drilling of a water well; and WHEREAS, bids were received on December 10, '1979, from four (4) bidders for construction of a 12" water transmission line; 'and WHEREAS, bids on each project were referred to the project engineer, Mr. Matt Cannon, Langford Engineering, Inc. and the Director of Public Works for tabulation and recommendation. ' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: ' Section 1. That the City Commission does hereby find and determine that each of the proceedings herein outlined have been duly and legally per- r~ formed. U n 8" , I: " N: , , I O'OO:lttu Section 2. That the City Commission hereby accepts the written recommendation of Mr. Matt Cannon, project engineer, Langford Engineering, Inc. and the Director of Public Works, that the contract for drilling a water well be awarded to Layne-Western Company on their low bid of $318,675.00 and that the contract for construction of a 12" water transmission line be awarded to Jalco, Inc. on their low bid of $74,655.00. Section 3. ' That the City Commission does hereby determine that the sum of $393,300.00 is required to finance the d;rilling of a water well and construction of a 12" water transmission line. Section 4. That $393,300.00 is hereby appropriated from the Water/ Sewer Fund Retained Earnings Account, which funds have not been appropiated for any other purpose, to satisfy the heretofore contract awards. Section 5. That Layne-Western Company and Jalco, Inc. shall submit Certificates of Insurance acceptable to the city which shall meet the minimum insurance requirements as follows; A. Workmen's Compensation and Employer's Liability Insurance B. Comprehensive General Liability with limits npt less than Bodily Injury Liability $100,000/person $300,000/aggtegate Property Damage Liability $ 50,000/accident 100,000/aggregate This policy must provide contractual liability coverage for all liability assumed by the Contractor, for himself or his sub- contractors under this Contract. C. Comprehensive Automobile Liability with limits not less than Bodily Injury Liability $100,000/person 300,000/accident Property Damage Liability 35,000/accident Section 6. That Layne~Western Company and J alco, Inc. shall submit to the city acceptable performance bond and payment bond in the amount of 100% of the contract price, which bonds must be approved by the City Attorney prior to the execution of the contract. Section 7.
