AN: O)IDINANGE OF THE CITY OF WEST UNIV;ERSrfY PLACE, TEXAS,
RETAINING THE tAXES IMPOSED BY THE LOCAL SALES AND, USE TAX
ACT (ARTICLE 1066c, YERNON'S TEXAS CIVIL, STATUTES) ON THE
SALE AND DISTRIBUTION OF. GAS AND E~ECTRIGITY FOR RESIDEN-
~IAL US~ IN SAID CITY.
WHEREAS, the State Legislat~re enacted a bill which~exmpted residen-
tial use from the 4% State sales tax, the bill being effective October 1, 1978,
and,
WHEREAS, said bill provided, that unless an ordinance retaining the
tax is' approved' by ,the City prior to May 1, 1979, the 1% City sales tax on
residential use of gas and electricity will be automatically abolisheq effec-
tive October 1, 1979; and
WHEREAS, the best interest of the City would be served by retaining
the City's 1% sales tax as provided by Article 1066c,Vernon's Texas Civil
Statutues. '
NOW,' THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF WEST UNIVERS ITY PLACE., tEXAS:
THAT the City of West University Place, Texas, by majority vote of 0
its governing body, hereby votes to retain the taxes authorized by the Local !,'
Sales and Use Tax Act (Article 1066c, Vernon's Texas Civil Statutes) on the
receipts from the sale, production, distributipn, lease, or rental of, and
the use, storage, or other consumption of gas and electricity, ,for residential
use, as authorized by Section 6 of House Bill No.1, Acts 1978, 65th Legis-
lature, Second Called Session.
PASSED AND APPROVED this 23rd day of April 1979.
