HomeMy WebLinkAboutORD 1110 - Amending Code of ORD Section 11-1 & 11-2 Prrovide Adoption 1976 Edition Standard Fire Prevention Code ORDINANCE NUMBER 1110 ~1 o.oe~g:at(;;~' ~-' ~f~ " .~ ~f"'~:!' ~., D:I " 1 , i -I , I AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS BY AMENDING SECTIONS 11-1 AND 11-2 TO PROVIDE FOR THE ADOPTION OF THE 1976 EDITION OF THE STANDARD FIRE PREVENTION CODE, WITH 1977 AND 1978 AMENDMENTS, EXCEPT AS TO CERTAIN PROVISIONS SPECIFICALLY DELETED, MODIFIED OR AMENDED; PROVIDING FOR THE FILING OF THREE (3) COPIES OF SUCH CODE IN THE OFFICE OF THE CITY SECRETARY; AND PROVIDING AN EFFECTIVE DATE., BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That Section 11-1 of the Code of Ordinances of the City of West University Place is hereby amended so that hereafter said Section 11-1 shall read as follows: "Section11-1. Adoption of Fire Prevention Code ~;i:: I: I: ',! . There is hereby adopted by the City Commission for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain'code known as the Standard Fire Prevention Code, being particularly the 1976 edition, with 1977 and 1978 amendments, and the whole thereof, save and ex- cept such portions as are hereinafter deleted, modified or amended, of which code not less than three (3) certified copies have been and now are filed in the office of the city secretary and the same are hereby adopted and incorporated as fully as if set out at length herein, the provisions thereof shall be controlling within the limits of the city." Section 2. That Section 11.2 of the Code of Ordinances of the City of West University Place is hereby amended so that hereafter said Section 11-2 shall read as follows: "Section 11.2. Amendments to the Fire Prevention Code Section 17.03(b) is amended to read as follows: Wil II II 1,1 b. Except as hereinafter provided, it shall be unlawful for any person to possess, store, to offer for sale, expose for sale, sell at retail, transport, or use or explode any fireworks; provided that the Fire Official shall have power to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks by a jurisdiction, fair associations, amuse- ment parks, other organizations or for the use of fireworks by arti- sans in pursuit of their trade. Every such use or display shall be handled by a competent operator approved by the Fire Authority hav- ing jurisdiction, and shall be of such character and so located, discharged or fired so as not to be hazardous to property or endanger any person. Every service station open to the public shall [ I have an attendant or supervisor on duty whenever the station is open for business. If the dispensing of Class I liquids at a service station available and open to the public is to be done by a person other than the ser- ',vice station,attendant, the nozzle shall be a listed automatic closing type without hold open devica. Section 32.103 is amended by the addition of Sub-sections f and g: f. Incinerators shall be used only during the hours of one (1) hour after sunrise to one (1) hour befote sunset, and that during the time the'incinerator is in use, it shall not be left unattended. g. The incinerator shall not be used for the burning of garbage of any type, the burning of rubber or petroleum products or any substance that will give off 'obnoxious odors. Section 3. This ordinance shall take effect and be in force immediately from and after its passage and approval as required by law. PASSED AND APPROVED this 13th day of March, 1978.
