AN ORDINANCE FINDING AND DETERMINING THE NECESSITY FOR
MAKING EMERGENCY REPAIRS TO INTERNATIONAL HARVESTER TDlS
CRAWLER TRACTOR USED AT THE SANITARY LANDFILL; DETERMINING
THAT MAKING THE NECESSARY REPAIRS SHOULD BE ACCOMPLISHED
EFFICIENTLY AND ECONOMICALLY ON A 'FORCE ACCOUNT BASIS;
SELECTING THE FIRM ,OF PLAINS MACHINERY COMPANY OF HOUSTON,
TEXAS TO MAKE SUCH REPAIRS AS AN INDEPENDENT CONTRACTOR;
AND FINDING AND DECLARING AN EMERGENCY FOR THE MAKING OF
SUCH REPAIRS.
WHEREAS, it was ascertained that the International Harvester TDlS
Crawler Tractor used in the city's operation at the sanitary landfill was in
dire need of majo!_repairs to place and keep such machine in proper condition
to perform the work required at ,said sanitary landfill; and
WHEREAS, it was necessary that such repairs be made at the earliest
possible time to prevent an interruption of the operations at the sanitary
landfill; arid
WHEREAS, the City Manager advised the City Commission on August 8,
1977 that the International Harvester TDlS Crawler Tractor was unoperable and
needed extensive repairs which at the time was estimated at $5,300.00, and
WHEREAS, the City Commission authorized the City Manager to proceed
with having the repairs on the tractor made by Plains Machinery Company,
Houston, Texas; and '
WHEREAS, the full extent of the repairs could not be determined until
the tractor was torn down and rebuilt; and
WHEREAS, the exact amount of parts, labor, material and transportation
of the tractor amounted to $6,810.46, and
WHEREAS, it was not projected that extensive repairs would be needed
for the tractor during the year 1977, only $2,000.00 was budgeted for minor
repairs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMI~SION OF THE CITY OF
WEST UNIVERSITY PLACE, TEXAS:
Section 1. That the City Commission of the City of West University
Place, Texas finds and determined the necessity for making the extensive re-
pairs to the International Harvester TDlS Crawler Tractor used in its operation
at the sanitary landfill which consists of replacing steering brake disks, re-
placing pinion, bearings and seals, replacing carrier bearings, rebuilding and
reinstalling the final drive assembly, replacing master pinion track and re-
placing side track plate and transportation to and from the shop site.
Section 2. That Plains Machinery Company of Houston, Texas, a repu-
table firm, experienced in repairs and maintenance of machinery of this kind
did make the required repairs and the tractor is now in service and operating
satisfactorily.

Section 3. That the action of the City Manager and Sanitation Super-
intendentin having repairs made in the amount of $6,810.46 by said Plains
Machinery Company on an emergency basis in order to operate the sanitary land-
fill in accordance with the required practice be ratified 'and confirmed.
, Section 4.1hat the cost of such repairs exceeded the amount
appropriatedln the 1977 budget and it is therefore necessary and the City
Commission does hereby appropriate an additional $4,810.46 from the unappro-
priated surplus of the General Fund for' the 'cost of 'making the necessary
repairs to the said tractor.' "
Section 5. That because of the nature of .the operation of the sani-
tary landfill to comply with State Health Department regulations, an emergency
did exist because the tractor was inoperable, therefore the work was done on
an emergency force 'account basis.
