ORDINANCE' NUMBER 1012
AN ORDINANCE AMENDING THE' CODE OF .ORDINANCES OF THE CITY OF
WEST UNIVERSITY PLACE, TEXAS REGULATING FENCES AND WALLS BY
INCREASING THE MAXIMUM HEIGHT AND THE METHOD OF CONSTRUCTION
OF FENCES, AND PROVIDING AN EFFECTIVE DATE.
mE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY
PLAC E, TEXAS:
Section 1. That Section 6-39 of the Code of Ordinances of the City
of West University: Place, Texas is hereby amended to read as follows:
"Section 6-39. Maximum height. No fence or free standing wall may
be constructed on any private property exeeeding six (61) feet in
height; provided, however, that a fence completely constructed of
wood may be constructed to a height not~~c.eed1'ng~ei,ght:(?I,)'tf~et_
in height." '
Section 2. That Section 6-41 of the Code of Ordinances of the City
of West University Place, Texas is hereby amended to read as follows:
"Section 6-41. Extension beyond main wall prohibited; main wall de-
'fined. No fence, wall or other structure shall be erected on any
lot or private premises which said fence, wall or other structure
shall extend beyond themJlain wall of the front of the house located
on said lot. By the use of the term main wall as used herein, it is
intended to mean the front of the building exclusive of front
porch or entranceway; provided, however, that a retaining wall whose
express purpose is to hold in position earth or similar material, may
be constructed in said front yard. The maximum height of the wall
cannot exceed the highest portion of e1evatian of the front yard be-
tween'the main wall of the dwelling and the front property line, in-
cluding either side of the yard. Such retaining wall, or any portion
thereof, shall not be constructed beyond the property line. II
Section 3. That Section 6-47 of the Code of Ordinances of the City
of West University Place, Texas is hereby amended to read as follows:
"Section 6-47. facing of fences. All fences abutting on a street
shall be constructed so that all supporting members, including posts
and horizontal runners, shall not face the street. This provision
shall apply to such portions of a fence that shall face the street
on which the lot faces as well as a side street."
Section 4. That Section 6-53 of the Code of Ordinances of the City
of West University Place, Texas is hereby amended to read as follows:
"Section 6-53. Parallel fences. When a fence is constructed on a
common property line, where there is presently existing fence, the
new fence shall be so constructed as to be completely flush with the
existing fence in such a manner that trash ana debris cannot collect
between such fences."

Section 5. This ordinance shall take effect and be in force immed-
ia,te1y from and after its passage and approval as requir!ed by law.
