AN ORDINANCE FINDING AND DETERMING THAT EACH AND ALL
OF THE. 'P'RIDCEEDINGS HAVE BEEN HAD AND ALL THINGS D01\1E
PREREQUISITE TO THE HOLDING OF A PUBLIC HEARING TO
CONSIDER THE AMENDING OF ZONING ORDINANCE NO. 111 OF,
THE CITY OF WEST UNIVERSITY PLACE, TEXAS SO AS TO PER-
MIT THE CONSTRUCTION OF A CARPORT EXTENDING FROM THE
FRONT OF THE EXISTING GARAGE STRUCTURE FOR A DISTANCE
OF 15 FEET TO THE SIDE PROPERTY LIIiJE ON TEE EAST ONE-
HlU.F (1/2) OF LOT 6, BLOC}} 50 ,vVEST UNIVERSITY PLACE
SECOND ADDITION; FINDING THAT A PUBLIC HEARING FOR THE
PURPOSE OF CONSIDERING AN AlvlENDMENT TO ORDINANCE NO.
111 HAS BEEN DULY AND LEGALLY HEARD; APPROVING AND
ADOITING THE REPORTED RECOMMENDATION OF THE ZONING
AND PLANNING BOARD THAT ORDINANCE NO. 111 BE AMENDED
SO AS TO PERMIT SAID CONSTRUCTION,.; FINDING THAT
ORDINANCE NO. 111 OF THE CITY OF WEST UNIVERSITY
PrACE SHOULD BE SO AMENDED; M4E:NDING ORDINANCE NO.
111 PERMITTING SUCH CONS'rRUCTION; A1\TD PROVIDING AN
EFFECTIVE DATE.

vfHEREAS, :Mr. J. O. Eubanks has heretofore duly and properly re-
quested permission for the construction of a carport on the east
one-half of Lot 6, Block 50 of West University Place Second Addition
extending from the front of the existing garage on said property a
distance of 15 feet to the east property line on Rutgers Street; and
WHEREAS, the Zoning and Planning Board of the City of WestUni-
versity Place,' having considered the said request of Mr. J. O. Eubanks,
has submitted its recommendatiorr'~that the same should be granted sub-
ject to a public hearing before the City Commission of said city; and
WHEREAS, a proper notice of such hearing was given by publica-
tion in the Houston Chronicle and notice was!!,mailed to each of the
owners of property within 200 feet of the aforesaid lot; and

~~S, pursuant to such notice a public hearing was held by
the CitYiCommission at the City Hall, 3800 University Blvd., at 7:30
o'clock ~.M!,Monday, July 24, 1961; and
WHEREAS, the City Commission is of the opinion that the request
of Mr. J. O. Eubanks should be granted:
NOW, THEREFORE, BE IT ORDATNED BY TEE CITY COMMISSION OF THE
CITY OF WEST UNIVERSITY PLACE, TEXAS:

Section 1. That the City Commission of the City of West Uni-
versity Place hereby finds and determines that all formalities
required by Ordinance No. 111 of said city relative to the request of
~tr. J. O. Eubanks for an amendment to the said Ordinance to permit
the construction of a carport to extend east from the existing garage
to the side property line, have been met.

Section 2. That the report and recommendation of the Zoning
and Planning Board relative to the request of ~k. J. O. Eubanks be, .
,and it is hereby, approved and adopted.

That Section 24 of Ordinance No. III of the City of
Place, Texas is hereby amended by the addition of
to be known as sub-paragraph No. 3F to read as

tI (3F). provided, however, that on the east one-half of
Lot 6, Block 50, of West University Place Second Addition,
a carport may be constructed in front of the existing garage
and to extend east from such garage to the side property
line on Rutgers Street; provided, however, that such carport
shall never be enclosed on its north and south sides and
further provided that neither the roof or any supports of such
carport will extend beyond the east property line of said lot,
the said property line being the right of way line of Rutgers
Street, and further provided that such carport shall be
constructed in.accordance with plans and specifications on
file with the Building Inspector of the City of West Uni-
versity Place, Texas. tI
