QRDINANCE;NO. 788
AN ORDINANCE MAKING' NEGLIGENT COLLISION AN OFFENSE, AND
PROVIDING A PENALTY; DEFINING NE(l[,IGENCE; PROVIDING THAT
PR:OOF OF NO INTENT ON PART OF OPERA'IDR IS NO DEFENSE TO
CHARGE; EXEMPTING AUTHORIZED FIRE AND POLICE VEHICLES
AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CI'1Y OF WEST
UNIVERSITY PLACE, TEXAS:

Section 1. (a) If' any, driver or operator. of- a vehicle upon any
public street or upon any drive iri any public park, within the cor -
porate limits of' the city, shall with negligence, as in def'ined in the
penal code of' this State in the title and chapter on negligent homi -
cide, collide with or cause damage to any other vehicle of' any kind
whatsoever, or with any other property: at any place within the -said
corporate limits of' the city, he shall be held guilty of' negligei"T.
collision, and upon conviction shall be fined not less than one dollar
nor more than two hundred dollars.
(b) Proof' of' no intent on the part of' any operator
of: any vehicle charged with an off'ense under this section to collide
wi th any other vehicle or with any other property shall be no def'ense
to any charge f'iled under the authority o~ such section.
(c) Nothing contained in this s8'ction shall authorize
the prosecution of' any person f'orthe violation of' the same while such
person is operating any f'ire department or police department vehicle
of' the city in the perf'ormance of' his duty, provided, that it shall
not be necessary in any complaint, action or proceeding under this
section to negative this exception, but the same shall be proved by
the def'endant by way of defense.

Section 2. this ordinance shall take effect and be in force frem
and af'ter its passage and approval and publication according to law.
