Ii " 'II , , '2:0 ORDINANCE NO. 784 AN ORDINANCE FINJ))ING AND DETERMINING THAT ALL PROCEEDINGS ItAVE HERETOFORE BEEN COMPLIED WITH AND ALL THINGS DONE PREREQUISITE TO THE EXECUTION OF A CONTRACT FOR THE CONS- TRUCTION OF TWO BUILDINGS FOR THE CITY OF WEST ,UNIVERSITY , PLACE,. . TEXAS : (1) EQtJIPMElfr AND STORAGE BUILDING ( 2) UTILITY STORAGE, BUILDING & WATER METER SHOP RECITING THE DATE TO RECEIVE BIDS FOR CONSTRUCTION OF SAID BUILDINGS; REFERRING SAID BIDS TO THE CITY MANAGER AND CITY EWGINEER FOR TABULATION AND RECOMMENDATION; APPROPRIATING THE NECESSARY FUNDS FOR CONSTRUCTION OF SAID BUILDINGS; APPROVING AND ADOPrING RECOMMENDATION OF THE CITY MANAGER AND CITY ENGINEER; APPROVING AND ACCEPrING THE COm'RACTOR'S BONDS AND INSURANCE IN CONNECTION WITH SAID IMPROVEMENTS; AWARDING CONTRACT TO THE JOE E. HAJDIK CONSTRUCTION COMPANY AND AurHORIZING AND DIRECTING THE EXECUTION THEREOF BY THE MAYOR ON 'BEHALF OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS. WHEREAS, by previous action of the City Commission it was determined that facilities were inadequate to house the city's ~arbage trucks and Water Department equipment, and that proper sanitaryf'acilities did not exist and there was dire need for a new building to house Water Department materials and supplies and equipment, and for a new Water Meter Shop, and WHEREAS, it was determined advisable to demolish the present facilities, which consisted of a metal-clad wood frame building and construct in its stead two masonry buildings, and WHEREAS, a draftsman was obtained to assist the City Engin~er and other personnel in the preparation of plans and specifications for the construc- tion of said buildings, said plans and specif'ications subsequently being approved by the City Commission after certain r~visions were made, and WHEREAS, by appropriate action of the City ComID1ssion Notice to Bidders was published in the Houston Chronicle Sepibember 21, 1960; Bids were re- ceived on October 10, 1960, and WHEREAS, on the date of October 10, 1960, 17 bids were received and re- sults read aloud and announced at a meeting of the City Commission and referred to the City Manager and City Engineer for tabulation and re- commendation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE'" TEXAS: Section 1. That the City Commission of' the City of West University Place, Texas, does hereby f'ind and determine that each of the proceedings hereinabove mentioned have been duly and legally taken and performed in ~ull compliance with the Charter and Ordinances of the City of West University Place, Texas I .'I'IL o ~ J ;21 Section 2. That the two buildings are to be constructed on property owned by the City of West University Place, Texas, fronting on Amherst Street, as follows: :Lots 4 and 5, ,Block 19, Collegeview Addition Sectionl, purchased August 13, 1959; and fronting on Milton Street, as follows: Lots 3 and 4, Block 18, Colle,geview Addition Third, pur- chased September 1, 1931, and Lot 5, Block 18, Collegeview Third Addition, purchased May 15, 1943.' Section 3. That funds are ,herewith appropriated from the Water-Sewer Fund in tQe amount of $57,218, exclusive of alternates for solar tile, a.s<evidenc~d by TreasurerfsCertificate 60-1, duly certified to by the city Treasurer. ' Section 4. That the report and recommendation of the City Manager and City Engineer, on bidS received October 10, 1960, for construction of tl1etwo buildings, is hereby accepted and approved. Section 5. That the lowest secure bid deemed most advantageous to the: City is determined to be that of Joe E., Hajdik Construction' Company, 3406 Airport Road, Rosenberg, Texas, which is hereby found and deter- mined to be the lowestresponsibleibidder on said improvements and that said 'bid is hereby accepted. ' Section 6. That the Performance and Maintenance Bonds, presented,by the said Joe 'E.lIajdik Censtruction Company, with the Fidelity ana ~pdSit Compa,ny of Maryland, in the sum of $57,218.00 as surety,' hav:fngbeen examined, are ,hereby approved and accepted. Section 7. Insurance requirements, ,as set forth in the contract documents, including coverage of Workmen's Compensation, Builder's Risk, Bodily Injury and Property Damage, are hereby accepted. Section 8. That a contract ,and agreement, as set forth in the con- tract documents, between the City of West University Place, Texas ,and Joe E. Hajdik Construction Company, 3406 Airport Road, Rosenberg,Texas, for the construction of two buildings, as hereinabove described, is hereby approved. Section 9. The Mayor is hereby authorized to approve and sign said contract and agreement between the City and the said Joe E. Hajdik Construction Company.
