.AN ORDINANCE FINDING .AND DETERMI:NING' THAT EACRANDALLOF:THE
PROCEEDINGS HAVE BEEN HA:O AND ALL THINGS PREREQUISITE TO THE
HOLDING OF A PUBLIC HEARING TO CONSIDER ,THE M'lENDING OF ZONING
ORDINANCE NO. 111 OF THE CITY OF WEST'UNIVERSITY PLACE, TEXAS
SO AS TO PERMIT THE SUBDIVISION OF LOT 2, BLOCK 3l:t, COLLEGE-
VIEW FOURTH ADDITION AND TO PERMIT AN EXCEPl'ION TO THE SETBACK
REQUIREMENT; FINDING THAT A PUBLIC HEARING FOR THE PURPOSE OF
CONSIDERING .AN AMENDMENT TO ORDINANCE NO. 111 F...AS BEEN DULY,
AND LEGALLY HELD; APPROVING AND ADOPTING THE REPORTED RE -
COMMENDATION OF THE ZONING AND PLANNING BOARD THAT ORDINANCE
NO. 111 BE AMENDED SO AS :::D.gPERMIT SAID SUBDIVISION AND EX-
CEPTION TO THE SETBACK REQUIREMENT; FINDING THAT ORDINANCE
NO. 111 OF THE CITY OF WEST UNIVERSITY PLACE SHOULD BE SO
AMEJl.1DED; AMENDING ORDINANCE NO. lllPERMITTIlifG SUCH SUB-
D:):VISION; AND PROVmING .AN EFFECTIVE DATE.
WHEREAS, :Mr. W. A. Claytor has heretofore duly and properly requested
permission for the subdivision of Lot 2, Block 34, Collegeview Fourth Addi-
tion in order that 30 feet of said Lot adjoining Lot 3, Block 34, could be used
in conjunction with said Lot 3 and requesting an exception to the setbackre-
quirement; and
WHEREAS, the Zoning and Planning Board of the City of West University Place
having considered the said request of ~~.W. A. Claytor, has submitted its re-
commendation thaf the same should be granted subject to a public hearing before
the City Commission of said City; and
. WHEREAS, proper notice of such hearing was given by publication in the
Houston Chronicle on August 26, 1959 and notice was mailed to each of the
owners of property within 200 feet of the aforesaid lots; and
WHEREAS, pursuant to such notice a public hearing was held by the City
Commission at the City Hall, 3800 University Blvd., at 8:00 o'clock p.m. Monday,
September 14, 1959; and
WHEREAS, the City Commission is of the opinion that the request of lf~.
W. A. Claytor should be granted;
NOW; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
WEST UNIVERSITY PLACE, TEXAS:
Section 1. That the City Commission of the City of West University Place
hereby finds and determines that all formalities required by Ordinance No. 111
of said City relative to the request of ~~. W~ A. Claytor have been duly com -
plied with for an amendment to the said Ordinance to permit the subdivision of
Lot 2, Block 34, Collegeview Fourth Addition and to permit an exception to the
setback ~equirement.
Section 2. That the report and recommendation of the ~oning and Plan-
ning B?ard relative to the request of :Mr. W. A. Claytor, be, and it is hereby,
approy~d'and adopted.

Section 3. ThatSecti6n, 2~"of Ordinance No. 111 of -the City of West
University Place, Texas is hereby amended by the addition of a sub-paragraph
to be known asi,sub-paragraph No. 38 to read as follows:
It:' (18) " :r;ot 2, 'Block 34, Collegeview Fourth Addition is hereby sub-
divt~ed to permit the use of 30 feet of said Lot in conjunction
with Lot 3, Block 34, as a'building site; and exception to the
setback requirement is hereby permitted to allow the main im -
provemerits to be placed 25=5 feet from the front property line
of said property; provided however, that any improvements placed
on such lot shall in all things comply with the existing. Ordinances
and Building Oode of the City of West University Place, Texas. II"
Section 4. This Ordinance will take effect and be in force immediately
from and after its passage and approval.
PASSED AND APPROVED THIS 23RD DAY OF NOVE:MBER, 1959.
