AN ORDINANCE FIl\TDING AND DETERMINING THAT EACH AND ALL OF THE PRO-
CEEDINGS HAVE BEEN HAD AND ALL THINGS DONE PREREQUISITE TO THE
HOLDn~G OF A PUBLIC HEARING TO CONSIDER THE AMENDING OF ZONING
ORDINANCE NO. 111 OF THECrry OF WEST UNIVERSITY PLACE, TEXAS, SO
AS TO PERMIT THE SUBDIVISION OF LOT 6 ; BLOCK 45; ~VEST UNIVERSITY
PLACE SECOND ADDrrION INTO TWO LOTS 50 x 150 FEET EACH; FINDING
THAT A PUBLIC HEARING FOR TEE PURPOSE OF CONSIDERING AN AMENDMENT
TO ORDINANCE NO. 111 HAS BEEN DULY AND LEGALLY HELD; APPROVING
AND ADOPTING T.HE REPORTED. RECOMMENDATION OF THE ZONING AND PLAN-:-
NING BOARD THAT ORDINANCE NO. 111 BE AMENDED SO AS TO PERMIT SA:rD
SUBDIVISION; FIND THAT ORDINANCE NO. 111 OF THE CITY OF WEST' UNI-
VERSITY PLACE SHOULD BE AMENDED SO AS TO PERMIT SUCH SUBDIVISION;

VIDING .A.J'.T EFFECTIVE DATE.
WHEREAS; Mr. B. O~ Penny has heretofore duly and properly re~uested permission
for the subdivision of Lot 6; Block 45; West University Place Second Addition
into two lots of 50 x 150 feet each; both of said lots to front on University
Boulevard; and
WHEREAS, the Zoning and Planning Board of the City of West University Place,
having considered the said re~ue'st of Mr. B. O. Penny, has submitted its re -
commen~ation that the same should be granted subject to a public hearing before
the City Commission of said City; and
~iHKREAS, proper notice of such hearing was given by publication in the
Houston Chronicle on August 26, 1959 and notice was mailed to each of the owners
of property within 200 feet of the aforesaid lots; and
WHEREAS, pursuant to such notice a public hearing was held by the City Com-
mission at the City Hall; 3800 University Blvd.; at 8:30 o'clock p.m., Monday,
September 14, 1959; and
WHEREAS, the City Cownission is of the opinion that the re~uest of Mr. B. O.
Penny should be granted:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO:M:MISSION OF THE 'CITY OF WEST
UNIVERSITY PLACE, TEXAS:
Section 1. That the City Commission of the City of West University Place here-
by finds and determines that all' formalities re~uired by Ordinance No. 111 of
said City relative to the request of t~. B. O. Penny have been duly complied with
for an ,amendment to the ,said Ordinance, to permit the subdivision of :Lot 6,
Block 45; west University Place Second Addition into two lots 50 x 150 feet each;
both of said lots fronting on University 13lvd.
Section 2. That the report and recommendation of the Zoning and Planning
Board relative to the re~uest of Mr. B. O. Penny, be, and it is hereby, ap -
proved and adopted.
Section 3. That Section 24 of Ordinance No. 111 of the City of West
University Place, Texas is hereby amended by the addition of a sub'-paragraph
to be known as sub-paragraph No. 37 to read as follows :

(37) Lot 6, Block 45, w~t University Place Second Addition is hereby
subdivided into two lots of 50 x 150 feet each, both of said lots to

front on University Blvd., provided,howeve~ that any improvements placed
on such lots shall in all things comply with the existing Ordinances and
Building Code of the City of West University Place, Texas. "
Section 4.' This Ordinance will take effect and be in force immediately
from and after its passage and approval.
