Home My WebLink AboutORD 768 - ORD Finding & Determining Permanent Improvemnt of Bissonnent Ave n TI J 233 ORDlNAl~CE NO. 768 AN ORDINANCE OF THE CITY COMMISSION OF THE Crry OF WESTUNIVERSrry PLACE, TEXAS, FINDDTG AND DETERMINING THAT IN THE MATTER OF THE PERMANENr IMPROVEMENT OF BISSONNET AVENUE FROM THE WEST PROPERTY LI'NE OF irlAKEFOREST TO THE WEST PROPERTY LINE OF KIRBY DRIVE CERTAIN THINGS HAVE BEEN DONE AND CERTAIN EVENTS HAVE TRANSPIRED, INCLUDING THE LEVYING BY THE CITY OF HOUSTON OF ASSESSMENTS OF PART OF THE COST OF SUCH IMPROVEMENT AGAINST ABUTTING PROPERTY LYING ON THE SOillH SIDE OF SAm PORTION OF BISSONNET AVENUE, WHICH ABUTTING PROPERTY IS WITHIN THE LIMITS OF THE CITY OF WEST UNIVERSITY PLACE; RATIFYING AND APPROVING S'QCH ASSESSMENT; AND DIRECTING THAT A CERTIFIED COPY O;F THIS ORDINANCE BE DELIVERED TO THE CITY OF HOUSTON AS ITS EVIDENCE OF SUCH RATIFICATION AND APPROVAL~ BE IT ORDAINED BY THE CITY COMMISSION OF TEE crry OF WEST UNIVERSITY PLACE,. TEXAS: Section 1. The City Commission of the City of West University Place hereby finds and determines that by Ordinance No. 59-1380, passed and approved September 23, 1959, (a certified copy of which Ordinance has been filed with the City Sec- retary of West University Place) the City Council of the City o~ Houston, in . connection with the proposed improvement of Bissonnet Avenue from the West prop- erty line of Wakeforest to the West property line of Kirby Drive, did levy assessment against the property abutting upon and along said portion of Bissonnet Avenue, and that said assessment, insofar as the same affects the abutting property upon-the South side of Bissonnet Avenue which is in the City of West University Place, are as follows: l~ SOUTH SIDE KIRBY DRIVE Total Property ~vner Lot umber or Description Property Frontage Assessment 1. Section 2. The City Commission of the City of West University Place, Texas, further finds and determines that thereafter a certified copy of the said Ordinance of September 23,1959, of the City Council of,the Ci~y of Houston was received by the said City Commission with a req,uest that as provided by Article 1105b, Revised Civil Statutes of Texas, commonly known as the State Paving Law, the ~aid City Commission of the City of West University Place consider the matter of ratifying and approving the said assessment herein- above referred to, and that thereafter by Ordinance the City Commission of the City of West Universi~y Place did order and direct that a hearing be held by and before it at its regular meeting to be held at 7: 30 o~clock P.M. on the 9th day of November, 1959, at its usual meeting place in the City Hall of and in the City of West University Place for the matter of considering the propriety of so ratifying and approving said assessment, and did direct that notice be given and a notice was given by advertisement thereof of the fact that such meeting was to be held, which notice was given by publication in the Houston Chronicle on October 28, 29 and 30, 1959, in which notice it was stated, among other things, the fact of the time and place at which such hear- ing would be held and of the matters to be then and there considered and of the fact that Hou~ton had so levied,said assessment against the said abutting property lying within the limits of the City of West University Place. Section 3. At the time and place stated in said notice, said hearing was held by and before the said City Commission of said City;and at said hear- ing all persons desiring to be heard in connection with said paving project or the proposed assessment or the proposed ratification and approval thereof by the said City Commission were heard;and the propriety of so ratifying and a.p- proving said assessment was and has been fully considered by the City Commission of the City of west University Place, being the governing body of said City. Section 4. The City Commission of the City of West University Place does hereby in all, things ratify and approve the said assessment so levied by the City Council of ;tp.e, C~ity of Houston as p.ereinabove set forth and listed and. as hereinabove otherwise mentioned. ... .... .. The City Secretary of the City of West University Place is hereby author~zed and directed to deliver a certified copy of this Ordinance to the City of Hpu?t9n~as its evidence and assurance that the said assess - ment so levied by it against the abutting property lying within the limits of the City of West University Place abutting upon the portion here~nabove described of Biss9npe:t ~venue have bee~ so ratified and approved by this, the City Commission of West University Place.
