HomeMy WebLinkAboutORD 767 - ORD Leving & Assessment against Abutting Property IT l ] 2'31" ORDINANCE NO. 767 J AN ORDINANCE OF THE CITY COMMISSION OF TEE CITY OF WEST UNIVERSITY PLACE, TEXAS, TAKING NOTE OF TEE PASSAGE BY THE CITY COUNCIL OF THE CITY OF HOUSTON OF AN ORDINANCE LEVYING ASSESSMENTS AGAINST TEE ABUTrING PROPERTY 'AND THE OWNERS THEREOF ABUTTING UPON BISSONNET AVENUE (A STREET ,IN THE CITY OF HOUSTON; TEXAS) FROM THE WEST PROPERTY LINE OF WAKEFOREST STREET TO THE WEST PROPERTY LINE OF KIRBY DRlVEj RECIT~G THE FACT THAT SAID ORDINANCE, AMONG OTHER THINGS, LEVIED ASSESSMENTS AGAINST CERTAIN PROPERTY IN THE CITY OF WEST UNIVERSITY PlACE TO PAY PART OF THE COST OF IMPROVING BISSONNET AVENUE :m.sTWEEN THE LIMITS AFORESAIDj DECIARING THE llITENTION OF TEE CITY COMMISSION OF THE CITY OF WEST UNIVERSrry PLACE TO CONSIDER THE PROPRIETY OF RATIFYING AND APPROVING SAID ASSESSJI.1ENTS j ORDERING THAT A BEARING BE HELD UPON MATrERS RELATED THEBETO j AND FIXING THE TIME AND PlACE OF SUCH HEARING. WHEREAS, pursuant to proceedings' duly had in accordance with the provisions of Article 1105-b, Revised Civil Statute~ of Texas, the City Council of the City of Houston, Texas, did on September 23, 1959, adopt its Ordinance No. 59-1380, which said ordinance, among other things, levied assessments against the prop - erty abutting upon both sides of Bissonnet Avenue between the west property line of Wakeforest Street and the west property line of Kirby Drive, such assessments being in the amount of $16.21 per front footj and WHEREAS, two certified copies of said ordinance of the City of Houston have been filed with the City Secretary of the City of West University Placej and WHEREAS, the property abutting on the south side of Bissonnet Avenue.petween; the west property line of Wakeforest Street and the west property line of Kirby Drive lies within the City of West University Placej and WHEREAS, City Commission of the City of West University Place proposes to consider the propriety of ratifying and approving said assessments heretofore levied by the City Council of the City of Houston insofar as the same affect,sa.id property lying within West University Place, and proposes 'to hold a public hearing upon the matters related to such ratification and approvalj NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PlACE: Section 1. The City Commission of the City of west University Place hereby d~clares its intention at or following the hearing hereinafter set and ordered to consider the propriety of ratifying and approving the assessments heretofore levied by the City Council of the City of Houston against the property abutting upon the south side of Bissonnet Avenue between the west property line of Wake - forest street and the west property line of Kirby Drive, such assessments being in the amount of $16.21 per front foot. The City Commission hereby orders that a, hearing will be had and held by and before the City Commission of the City of ,West University Place at a regular meeting to beheld at 7:30 P.M. o'clock, on November 9, 1959, at the regular meeting place of such CommiSSion in the City Hall of and in the City of West University Place, at which time and place all persons having any interest whatsoever in any of the matters herein referred to and, in particular, all persons owning or having any interest or claim in any of the said abutting property, shall have the right to appear and to be heard on any matter related thereto, including any matter as to which a hearing may be a cons- titutional prerequisite to the validity of said assessments or to the validity of the ratification and approval thereof by the City Commission of the City of West University Place, and the accuracy, sufficiency, regularity and validity of any of the proceedings in connection with such improvement and assessments. . , '--'1 .1._. 1- L-_.~ "'..__,........"... ~~.~~______I',.:!';rf!IM'fn;!:'l?.."J.l!!"n Wl'1:'1'I" ~\3.2 ,-' · ,Section~. At or following such hearing the City Commission of the City of West Univers~ty Place will consider and act upon the matter of the ratification and approval by it of the said assessments so made by the City Council of the City~of Houston against the said abutting property lying within the limits of the City, of West University Place; and if it deems such action proper, it will by appropriate ordinance or resqiution ratify and approve the same. ! \ ~" . , ";':' ,n;, - , ., ; Section 3. The City Secretary of the City of West University Place is direct- ed to give notice of such hearing, which notice shall be addressed to all owning or claiming any property abutting upon the herein mentioned portion of B~ssonnet Avenue and to all owning or claiming any interest in such property, and particularly to those owning or claiming so much of such property as lies within 'the limits of the City of West Upiversity Plac~, such notice to be,given by~dv~rtisement thereof inserted at least three times in the Houston Chronicle, a newspaper published in the City of Houston and having a general circulation in the City of west University Place, the first publication to be made at least ten days before the date of said hearing. In such notice the City Secretary shall describe in general terms the nature of the proposed improvements, shall state the street and the portion thereof to be improved, and shall state the amount or rate per front foot of the assess - ments which have been so levied by the City Council of the City of Houston, shall state the estimated total cost of such improvement and shall state the time and place at which hearing shall be held. There may also be included in such notice such further date and information regarding such proposed improvement and such assessments as the City Se'cretary considers sufficient to acquaint those to whom it is directed with the fact that they have a right to be heard and to inform them of the matters to be considered at such bearing and of the matters upon which they are entitled to be heard.
