AN APPLICATION TO BE MADE FOR ERECTION OF A FENCE OR WALL; SETTING FORTH TEE COST OF PERMIT; PRESCRIBING THE RESPONSIBILITY OF TEE CONTRACTOR FOR INSTALLING::'THE FENCE OR WALL AND, REMOVING DEBRIS; PROVIDING A PENALTY OF Nor LESS THAN ONE DOLLAR ($1) NOR MORE THAN TWO HUNDRED DOLLARS ($200) FOR VIOLATION AND PROVmING FOR EFFECTIVE DATE; AND REPEALING AI.L ORDINANCES' OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE. BErrORDAIIilED BY TEE CITY COMMISSION OF THE CITY OF WEST UNIVERSrry PLACE, TEXAS: Section 1. NO fence or wall may be constructed on any private prop- erty exceeding 6' in height. Section 2. No fence, wall or other structure shall be erected on any lot or private premises which said fence, wall or other structure shall extend beyond the main wall of the front of the house located on said lot. By the use of the term main wall as used herein, it is intended to mean the front wall of the building exclusive of front porch or entrance- way. Section 3. No brick, masonry' or similar type of fence or wall shall be erected which would interfere with the installation and main- tenance of utility lines in the easement reserved therefor. Section 4. Before any fence or wall shall be constructed herein- after on any lot, the owner of said lot shall apply to the,Building Inspector for a permit for the erection of said fence or wall, and"the cost of said permit shall be $2.00. Section 5. No perm~t for the construction of a fence or wall shall be issued by the Building Inspector unless and until he has been furnished with a letter or statement showing the type of fence or wall to be constructed, the materials to be used and the places where such fence is to be constructed~ Section 6.- It shall be the responsibility of the contractor to clean up and remove from the premises all debris, dirt, scrap and broken pieces of concrete, caused as ~ result of the construction of the fence or 1-1a,11. It shall be the responsibility of the owner and contractor to establish the property lines and have the location of the fence or wall thereon. Section 8. Any persol'l, agent or employee of any person, firm or corporation violating the provisions of the preceding Sections of this Ordinance shall be fined not less than $1.00 nor more than $200.00 and each day such person, firm or corporation shall allow such viola- tion-'uto exiFtt shall constitute a separate and additional/ offense. Section 9. All Ordinances or parts of Ordinances in conflict with this Ordinance is hereby expressly repealed. Section 10. This Ordinance shall take effect and be in force immediately after its passage and approval. PASSED AND APPROVED this the 11th day of May, 1959.
