AN ORDINA1~CE REPEALING ORDINANCE NO. 742 PASSED AND APPROVED
SE~MBER 8, 1958, AND ORDINANCE NO. 749 PASSED AND APPROVED

PURSUANT THERETO; DIRECTING THE CITY SECRETARY TO FILE A
NOTICE OF THIS ORDINA.1'ifCE WITH TEE COUNTY CLERK, OF HARRIS
CQUNTY, TEXAS; AND DECLARING AN EMERGENCY: '
BE IT ORDAINED by the City Commission of the City of
West University Place, Texas:
Section 1.
The City Commission of the City of West
University Place, Texas, does hereby find, determine and declare that by
Ordinance NQ. 742" duly and regularly passed September 8, 1958, it did
determine the necessity for and ordered the improvements of Westchester,
Rutgers and Vanderbilt Avenues in said City and caused a notice thereof to
be filed in the Office of the County Clerk of Harris County, Texas, on
September 11, 1958, and same was recorded in Volume 3108, Page 442, of the
Mortgage Records of said County as provided in Article 1105-b and Article
1220-a of the Revised Civil Statutes of Texas; that said Ordi~ancewas
thereafter amended by Ordinance No. 749, duly and regularly passed October
27, 1958; that all bids received for the performance of the work and
construction of the improvements contemplated and provided for in said
Ordinances have been rejected.
Section 2.
That each of said, Ordinances with
reference to the above mentioned and hereinafter stated portions of said
streets, to 'wit:
Section 1, WESTCHESTER AVENUE BETWEEN UNIVERSITY
BOULEVARD AND DUKE STREET
Section 2, ,WESTCHESTER AVENUE BETWEEN CASON STREET
AND' BELLAIRE BOULEVARD
Section 3,
RUTGERS AVENUE BETWEEN UNIVERSITY
BOULEVARD AND DUKE STREET

should be, and the same are, hereby in all things repealed and all proceedings
held thereunder should be, and same are, hereby in all things 'rescinded.
Section ~.
The City Secretary is hereby authorized
and directed to file a Notice with the County Clerk of Harris County, Texas,
to evidence the repeal of said Ordinances and reciting that the filing of
said Notice is no longer of any force or effect.
Section 4.
The fact that the City Commission is con -
sideringproceeding with the improvement of said portions of said streets on
a different basis making advisable the repeal and rescinding of said p~ior
Ordinances and proceedings thereunder so that the new proceedings shall be
clearly separate and different therefrom and the fact that said portions of
said streets are in need of improvement as promptly as possible creates a,
public emergency and, therefore, this Ordinance shall be passed finally on
the date of its introduction, this 23RD day of February; 1959, and shall take
effect immediately upon its passage and approval by the Mayor.
