ORDINANCE NO. 744
AN ORDINANCE REGULATING THE SPEED OF VEHICLES ON STREETS IN THE
CITY OF WEST UNIVERSITY PLACE IN A SCHOOL DISTRICT; DEFINING
"SCHOOL AND PARK DISTRICTIt AND SETTING PRD1A FACIE LTIvlITS, IN SUCH
DISTRICT; THE CHARGING OF VIOLATIONS HEREUNDER AND PROVIDING FOR
PUNISHMENT FOR VIOLA TIONS HEREOF.'.
BE IT ORDAINED BY THE CITY CCMMISSION DID THE CITY OF WEST UNIVERSITY
PLACE, TEXAS" THAT:
SECTION 1 - Speed Restrictions
(a) No person shall drive a vehicle on public street in the City of
West University Place, Texas, at a speed greater than is reasonable and prudent
under the conditions then existing, having regard to the actual and potential
hazards when approaching and crossing an intersection or a railway grade cross-
ing, when approaching and goiI,lg around a curve, when traveling upon any narrow
or winding roadway ~;' -or when such hazard exists with respect to pedestrians or
othertraffic ,or by reason of weather or street conditions; and in every event
speed shall be so controlled as may be necessary to avoid colliding with any
person, vehicle or other eonveyance on or entering the streets in compliance
with legal requirements and the duty of all persons to use due care.
(b) Where no special hazard exists that requires lower speed for
compliance with Sub-section (a) of this Section, the speed of any vehicle not
is escess of the limits specified in this Sub-section or established as here-
inafter authorized, shall be lawful, but any speed in excess of the limits
specified in this Sub-section or established as hereinafter authorized shall
be prima facie evidence that the speed is not reasonable or prudent, and that
it is unlawful:
(1) Twenty (20) miles per hour in any school or
park district. ,
SECTION 2 - ttpark Arealt and ItSchool Arealt means the territory con-
tiguous to and including a roadway when the property on one side or the other
of such roadway for a distance of 100 feet or more is in use for public park
or public school purposes.
SECTION 3 - The aforesaid maximum speed limitation shall be in effect
in said school district during the hours from 8 o'clock A. M. to 9:15 o'clock A. M.
and 1:45 o'clock p. Mo to 3:30 o'clock P. M. on the days of lilonday through
Friday of each week.
SECTION 4 - Penalty. Any person violating any of the provisions of
this Ordinance shall be guilty of a misdemeanor, and upon conviction there of
shall be punished by a fine or not less than $1.00 nor more than $200.00.
SECTION 5 - If any Section or portion of this Ordinance be held
invalid or unconstitutional, such invalidity shall not affect the remaining
portions of this Ordinance, it being'declared to be the intention of this
Commission to enact such portions separately 0

The regulation of the speed and flow of vehicular traffic 'in the City of
West University Place, Texas, being a matter of concern to the safety and
well being of the citizens of the City of West University Place, Texas,
and the need for such regulation being imperative, this Ordinance shall take
effect end be in full force and effect immediately upon its passage by the
_ City Commission and approval by the Mayor. '
