AN ORDINANCE AMENDING ORDINANCE NO. 723; .J.U1flrORIZING PAYMENT IN
FULL TO RUSS MITCHELL, INC. FOR SERVICES ~ IN MAKING :NECES-
SARY EMERGENCY REPAIRS TO THE SANITARY SEWER SYSTEM OF THE CITY OF
WEST 'UNIVERSITY PLAdE ,TEns; APPROPRIATING THE SUM OF $7,815.92
FROM THE SANITARY SEWER FUND FOR PURPOSE OF PAYMENT MID DECLARING
AN EFFECTIVE DATE.',_: ":'.
WHEREAS, by Ordinance No. 723 ,passed on the 25th day of February, 1957" the Mayor
and City Manager were' authorized to'bbtain the services of Russ-Mitchell, Inc.,
on a force account basis to effect the necessary emergency construction and
repairs to the sanitary sewer system caused by continuous breaks in a 10-inch
-li~e .in the easement between Westchester' and Rutgers Streets, bounded on the north
by 'Duke Street, and on the 'south by Pittsburg Street; and
WHEREAS" the work involVed in making such necessary repairs has now been complet-,
ed in a good and 'vorkmanlike manner and the said Russ-Mitchell, Inc. is entitled
_ to payment; and ' ,
WHEREAS, due to certain unforeseen circumstances over which neither the contractor
nor, the'City had anycoatrol" the amount due for such work is in excess .of the
originally estimated cost of Five Thousand Dollars; and

WHEREAS, the City Engineer, being cognizant of all circumsta.nces., and conditions
surrounding such work, and after careful inspection of the .jab performed, has
recommended to the City Commission ,that the 'statement of Russ-Mitchell" .Inc." 0
in the amount of $6,825.92 should be paid in full.
NOW, THEREFORE" BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVER-
sITY PLACE, TEXAS: "

Section 1. That the Mayor and City Manager be and they are hereby authorized to
pay to Russ-Mitchell" Inc., the s.um of ~6,825.92 for services rendered in con-
nection with the necessary emergency construction and repairs made to the sani-
tary sewer system in the easement between Westchester and Rutgers Streets"
bounded on the north by Duke. Street, and on the south by Pittsburg Street.
Section 2. That the sum of $7,815.92 is hereby appropriated from the sanitary
sewer fund for the purpose of making the aforesaid payment and for materials,
and such payment shall represent payment in full to said Russ-Mitchell, Inc.
for any and all vTork done on the aforesaid job. '
Section ~. Ordinance No. 723 is hereby amended to increase the amount of money
available for paylnent of the work involved from the sum. of $5,000 ,to the sum of,
$7,,815.92. '
Section 4. The sum of $990.00, representing the amount due for materials used
on said job and being the difference between the sum of $7,815.92 and $6,,725.92
shall be disbursed to such firms or individuals furnishing materials on said jOb.

Section 5. This ordinance shall take effect and be in forceinnnediately from and
