HomeMy WebLinkAboutORD 705 - ORD Amending ORD 700 Authorizing Mayorto Execute and Consumate the Sale of Certain Land .ITI L--_ -=--', , I r r---, -, 521 ORDINANCE NO. 705 AN ORDINANCE AMENDING ORDINANCE NO. 700 AUTHORIZING TEE MAYOR OF TEE CITY OF WEST UNIVERSITY PLACE, TEXAS, TO EXECUTE THE :NECESSARY INSTRUMENTS IN THE NAME OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, TO CONSUMMATE THE SALE, OF A CERTAIN TRACT OF LAND SITUATED IN HARRIS COUNrY, TEXAS, NOW BEING UTILIZED BY SAID CITY AS A GARBAGE ~ISPOSAL SITE: DESCRIBING TEE EXACT CONDITIONS 'OF SALE .AlID TEE RETEIilTION OF A VENDOR'S LIEN ON TRACT AS PARTICULARLY DESCRIBEDBEREIN EXCEPr FOR THE TEREE SEPARATE TRACTS ALSO PARTICULARLY DESCRIBED :HEREIN. WHEREAS, the City of West University Place, Texas, is the owner of a tract of land situated in Harris County, Texas, hereinafter described in full, which,has in the past been used by said City as a garbage disposal site; and WEEREAS, it has been determined by the City Commission of the City of West University Place, Texas, that it would be advantageous to said City to acquire a different tract of land in Harris County, Texas, to be used as a garbage disposal site; and - WHEREAS, it is necessary to sell the tract of land presently owned, by said City in order that the funds received from the sale of such property may be used in acquiring the property to be purchased. NOW, THEREFORE, BE IT ORDAIl'iIED BY TEE CITY COMMISSION OF TEE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section.l. That the Hon. Edwin W. MorriS, Mayor of the City of West University Place, Texas, be, and he is hereby, authorized to enter into the necessary agreements and to execute the necessary instruments, including a General Warranty Deed to sell and convey to Robert Vernon King for NI:NErY THOUSAND DOLLARS ($90,000.00), FORTY THOUSAND DOLLARs($40,000.00) to be paid in cash, and to obtain note for FIFTY THOUS.AlID DOLLARS ($50,000.00) at 4% interest per annum, payable in three annual installments of SIXTEEN THOUSAND SIX HUNDRED SIXTY-SIX and 66/100 DOLLARS ($16,666.66) plus interest, the first payment to be on or before March 13, 1957 and like payments on or before March 13, 1958 and 1959, the City to furnish Title Guaranty Policy to Purchaser, said property being described as follows: BEGINNING at a 3/4 inch iron pipe, a corner in fence, 40.6 feet West of the SoutbNrest corner of the Beckman Canfield Survey; THENCE East 529 feet along said fence, to another 3/4 inch iron pipe, a corner -in said fence, , ", ;fgJ::~t:g{:! RR; which Southeast corner is in the North line of the Alief Houston Road; THENCE along a fence and along the North line of Alief ' Houston Road South 85 degrees, 12 minutes West 549.24 feet to a 1 1/4 inch rod, a corner in fence for the Southwest corner of this tract; THENCE with said fence North 0 degrees, 10 minutes West 1569.93' feet to the PlACE OF BEGINNING, .containing; 19.185 acres, according tO'a survey made on the ground by J. S. Boyles, Surveyor, on June 7, 1946, and -being the same .land heretofore con- veyed to the Empire Corporation byiGeorge Caridas by a certain Deed dated August 16, 1948, recorded in Volume1858, Page 591, of the Deed Records of Harris County, Texas, . SAVE MID EXCEPI' an undivided one-half (1/2) of all gas, oil and other minerals which was reserved by Deed re- corded in Volume 1459, Page 229, of the Deed Records of Harris Co~nty, Texas, and LESS a strip of land con- taining 0.068 acres lying in public road along the South boundary line of the above property, leaving a net acreage of 19.119 acres of land. Section 2. That the General Warranty Deed conveying the a.bove described property from the City of West University to Robert Vernon King shall retain a Vendor's Lien for the unpaid portion of the sales price, which Vendor's Lien shall cover all of the property conveyed; except: TRACT 1. A tract of land 150 feet by 150 feet at the Northeast corner of the tract conveyed. TRACT 2. A tract of land 10 feet by 300 feet, more particularly .descr:tbed as follows: BEGINNING at the Northwest corner of the property con- . veyed; THENCE South 0 degrees 10 minutes East 300 feet along the West line of the property conveyed; THENCE East 10 feet; THENCE North 0 degrees 10 minutes West 300 feet to a point in the North line of the property conveyed; THENCE West 10 feet to the PlACE OF BEGINNING. \TRACT 3.
