AN ORDINANCE FnIDING THE NECESSITI FOR AND AUTIIDRIZING THE
PtJBCHASE OF A CERTAIN TRACT OF LAND SITUATED IN HARRIS COUNTY,
TEXAS, 10 BE USED AS A GARBAGE DISPOSAL SITE FOR THE InTI OF
WEST UNIVERSITY PLACE, 'lEXAS; AUTHORIZING THE PURCHASE OF SAID
PROPERTY FOR A CONSIDERATION WHICH SJW,L BE PARTLY IN, CASH AND
THE BALANCE OF SUCH CONSIDERATION BEING EVIDENCEtl BY THE EXEClJ.::;
TION OF THREE NOms; .AUmORIZING THE MAYOR OF SAID CITY ON ITS
BEHALF, ro EXECU'lE SAID Noms AND A DEED OF TRUST SECURING THE
PAYMENT OF SAID NOTES; AND PROVIDING THIS ORDINANCE TAKE EFF.l!X:T
AND BE IN FORCE DIMEDIATELY FROM AND AFTER ITS PASSAGE AND
APPROVAL. '
, WHEREAS, 1.t has been determined by the>City Commission of the City
of West University Place, Texas, after a. 'thorough inVestigation of the
matter that it would be advantageous for the City to sell the tract of
land which is presently being used by 1he City as a garbage disposal site;
and
WHEREAS, 'upon the sale of the tract of land now being used by the'
City as a garbage disposal site it will be necessary for the City to
acquire a tract of land for that purpose and it has been determined by
the City Connn;i.ssion, that the property hereinafter described is the best
and most suitable property available- for such use.
, NOW, THEREFORE, BE IT ORDAINED BY THE CrIT COMMISSION OF THE CITY
OF wEsT UNIVERSITY PLACE, TEXAS;
, Section 1. That the City of West University Plac~, Texas, shall
purchase the following described land as a garbage disposal site:.
Situated in Harris County, Texas, and being Lot No. Four (4)
of Ruby's subdivision of Section No. Five (5) Block No. Ten
(10) located by Certificate No. 5/253 H.T. & B. Ry. Company
Survey Patent No. 29, Vol. 12, patented to A. T.Morse,
Assignee.
Section 2. That the Hon.Edwin W. Morris, Mayor of the City of
West University Place, Texas, be, and he is hereby, authorized to execute
on behalf of the City, all necessary instrwnents to con,sunnnate said pur-
chase including an earnest money contract; promissoI7 notes and a Deed
of Trust to secure the payment of such notes.
Section 3. This ordinance shall take effect and. be in force
immediately from and after the date of its passage and approval.
