ORDINANCE NO. 700
AN ORDINANCE AUTHORIZING THE MAYOR OF 'lHE CITY OF WEST
UNIVERSITY PLACE" TEXAS, 'ID EXECU'IE'mE NECESS}.RY IN-
STRUMENTS IN THE NAME OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS, 10 CONSUMMA T.E THE SALE OF }.. CERTAIN TRACT
OF LA:ND SITUA'lED IN HARRIS COUNTY, TExAS, NOW BEING .
'UTILIZED BY SAID CITY AS A GARBAGE DISPOSAL SITE; DE-
SCRIBING SAID PROPERTY SPECIFICALLY AND SETTING FORm
CERTAIN PROVISIONS UPON WHICH SAID SALE SHALL BE MADE.
WHEREAS ~ the City, of West Uni versi ty Place, Texas, is the owner of
a tract of land situated in Harris County, Texas, .hereinafter described in
full, which has- in the past been used by said City as a garbage disposal
site; and
WHEREAS, it has been determined by the City Commission of the City
of West University Place, Texas, that it would be advantageous to said
City to acquire a different tract of land in Harris County, Texas, to be
used as a garbage disposal site; and '
WHEREAS" it is necessary to sell the tract of land presently owned
by said City in order that the funds received from the sale of such property
may be used in acquiring the property to be purchased.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF '!HE CITY
OF WEST UNIVERSITY PLACE, 'lEXAS: '
Section 1. That the Hon. Edwin W. Morris, Mayor of the City of
West University Place, Texas~ be, and he is hereby, authorized to enter
into the necessary agreements and to execute the necessary instruments,
including a General Warranty Deed to sell and convey to Robert Vernon
King for ,a consideration previously agreed upon between the City of West
Urtiversity Place, Texas, and Robert Vernon King, said property being
described as follows:
All that certain property situated in Harris County, Texas,
described as follows, to-wit:
BEGINNING at a 3/4 inch iron pipe, a corner in fence, 40.6 feet
West of the Southwest corner of the Beckman Canfield Survey;
THENCE East 529 feet along said fence to allot.her 3/4 inch iron
pipe, a corner in said fence, for the Northeast. corner of "this
tract; "
THENCE with said fence South 0 degrees, 52 minutes Eas;t.,., 1523.92
feet, a 3/4 inch iI~on 'pipe, a corner in said fence fo~ the
Southeast corner of this tract, being 110 feet at right" angles
from center of S.A. & A.P. 6; THENCE along said fence South '
85 degrees, 12 minutes West 549.24 feet_ to a 1 1/4 inch rod, a
corner in fence for the Southwest corner of this tract; THENCE
with said fence North 0 degrees, 10 minutes West 1569.93 feet
to the PLACE OF BEGINNING, containing 19.185 acres according
to a survey made on the ground by J. S. Boyles" Surveyor, on

June 7, 1946, and being the same land heretofore conve:r,ed to
The Empire Corporation by George Caridas by a cerla-inDeed dated
August 16, 1948, recorded in Volume 18.58, Page .591, of the Deed
Records of Harris County, Texas, SAVE AND, EXCEPT an undivided
one-half (1/2) of all oil, gas and other minerals which was
reserved by Deed recorded in Volume 14.59, Page 229, of the Deed
Records of Harris County, Texas, and LESS a strip of land con-
taining 0.068 acres lying in public road along the South Boundary
line of the above property, leaving a new acreage of 19.119 acres
of land.
Section 2. 'Ihat the General Warranty Deed conveying the above
described property from the City of West University Place, Texas, to
Robert Vernon King shall contain a provision to the effect that said City
shall continue to have the use and possession of the tract of land con-
veyed for the period of one year from the date af the instrument passing
title to Robert Vernon King and that the City shall. have the right d\iring
such year to use the property as a garbage disposal site so l.ongas the
use of such property by the City does not constitute a nuisance.
Section 3. This ordinance shall take effect and be in force from
and after its passage and approval.
