AN ORDINANCE CREATING mE OFFICE-OF CITY MANAGER FOR THE CIT!
OF WEST UNIVERSI'lY PLACE, TEXAS; PRESCRIBING HIS POWERS AND
DUTIES J PROVIDING FOR COMPENSATION AND DECLARING AN EFFEC TIVE

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF lmST UNIVERSITY
PLACE, TEXAS:
Section 1. City Manager: There is hereby created the office of
City Manager of the City of w~~t University Place, Texas.
Section 2. The City COlTl1J1ission shall appoint and emp10y a City
Manager who aha11 have and perform the duties, functions and obligations
-hereinafter provided. The City Manager of the City of West University
Place ~hall be the principal. administrative head of the DDlnicipa1. govern-
ment under the direction and supervision of the governing body.
Section 3. Residence of. City ~nager: Tlle City Manager mayor may
not be a resident of the City of Wes'f; University Place when appointed"
but during the term of his office sh4UJ. reside in the City of West Uni-
versity Place. . c' ,

Section 4. Tem of Offi~e: 1.'h~ City Manager shall be appointed
for an indefinite period, and shall be subject to discharge at the
p1easure of the City Commissi<';)n upon a majority vote and the giving of
thirty days prior notice. '
S~ction ~. Absence or di,sabi1ity of City Manager: During the
absence or disabi1ity of the City Manager, he shall designate some
properly qualified person to perform the duties of said office" and he
shall advise the. City Commissiontbe name of the employee he has so
appointed.
Section 6. Powers and Du.ties: The powers and duties of the City
Manager shall be:
(a) To devote all of his working time and attention to the affairs
of the city, and be responsible to the governing body for the
efficient administration of its affairs.
(b) , To recommend the appointment or removal. of all heads of depart-
ments and al.l subordinate emp10yees to the governing bo~ of the
city. He shall serve as Personne1 Director" andperfom. all
du ties, as prescribed in that section of the City Charter describ-
ing the powers and duties of the Personnel Direewr.
(c) To exercise supervision and control over all departinents created -..
by the goveming body or that may hereafter be created by said.

(d) To attend all meetings of the governing body with the right;
to take part in the discussion, but having no vote; and he,
shall be notitied of all special meetings of said governing
body.
To see that all tems and conditions imposed in favor of the
City of West University Place and its inhabitants in any
public utility franchise are faithfully kept and performed
and upon knowledge of any violation thereof to call the same
to the attention of the governing body. .

To review the budget as prepared by the City Treasurer and
submi't his recommendations concerning such budget to the Cit1
governing body.
To supervise the preparation by the City Treasurer of the
monthly statement as required by the Charter 01' the City.
(h) - To act as purchasing agent of the City of West University
Place" under such rules and policies as may be esta'Qlished
by the City Commission. The purchasing agent shall not let'
any contract for periods exceeding one year for public im-
provements" labor or supplies. In case of accident or ' other
circumstances creating a public emergency requiring immediate
action" the City Manager may" with the consent of the Mayor,
or in his absence" the Mayor Pro tem" take a.D7 necessary
.:' .: .,." 'remedial action, including the awarqing of contracts and the
making ot emergency purchases which may be required to avoid
or correct ~ch public emergency; provided, however, that
immediately, thereafter the City, Manager shall file with the
Mayor and City Commission a certificate explaining such public
emergency and the necessity of action taken, together with an
itemized account ot all expenditures.
(g)

(i) To recommEmd to the governing body the salaries to be paid
each appointive ofticer and subord.inate employee of the city;
and it shall be the duty of the governing body "to pass ordin-
ances or resolutions from time to time fixing rates of compen-
sation.
(j) To recommend to the governing body, in writing, from time to
time, for adoption, ' such measures as he may deem necessary or
expedient. '
(k) To do and perfom such other duties as may be prescribed by
ordinance or resolution of the governing body of the city.
(1) -.~. :_:. To sign or countersign all checks or vouchers drawn on
any fund of the City.

Section 7. Compensation and Bond of City Manager: The City Manager
shall receive such compensation as 1ihe governing body shall fix from time
to time by ordinance J and shall furnish such surety bond as may be required
by the governing body by ordinance !I the premium to be paid by the city.
Section 8. All ordinances of the city prescribing the dutiBs of
Heads of departments shall remain in full force and effect except insofar
as they conflict with 1ihe provisions of this' ordinance, in which case the
provisions of this ordinance shall govern. '
Section 9. This ordinance shall be effective on the day following
its final reading and passage.
