' 'I II 2 ft.- ,0- " ORDINANCE NO. 689 AN ORDINANCE REQUIRING FOOD HANDLERS TO HAVE PERMI'IS, PRESCRIBING CONDITIONS UPON WHICH SUCH PERMITS SHALL BE ISSUED, l-1AKING VIOLATIONS A MISDEMEANOR,.. AND ProVIDING PENALTIES. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: . (1) Food Handlers required to have Permit. No person shall be employed as, or engaged in the occupation of, a food handler as hereinafter defined, without having a permit therefor from the -Director of the City Health Unit. (2) Requirements for pennit. (8) Application for such pennit shall be made in writing signed by the applicant and stating the name, residence address, sex and age<of the applicant and having attached a photograph of applicant sufficient for the . p~oses of identification.. (b) Applicant shall take and successfully pass an examination, to be given by or under the direction of the Board of Health, on the sapitary handling of food and the laws and ordinances relating thereto. A fee of Five ($$.00) Dollars shall be paid for taking such examination, which fee is assessed for the purpose of paying part of the cost of giving such examination and is hereby declared to be a reasonable charge for that purpose. ' (c) Such examination shall not be required if the applicant shall take and successfully pass a food handlers course to be given by or under the direction of the Board of Health, on the sanitary handling of food and the laws and ordinances relating thereto. Such course shall consist of not less than six (6) nor more than twelve (12) hours of individual or . classroom watt, as may be determined by the Board of Health, and a fee of one ($1.$0) Dollar Fifty Cents shall be charged for such course, which fee .is assessed for the purpose of paying part of the cost ,of giving"such course and is hereby declared to be a reasonable charge for that'purpose. Cd) If an applicant has enrolled for such course the Director' of the City Health Unit shall issue a temporary permit to applicant, . until such time as the applicant has passed such course, or~s failed or refused to take the same when offered, or has taken the sf;)Iiiefnd failed to make a passing grade therein. - i ' (e) All permits heretofore or hereafter is-sued under t4s' ordinance shall expire four years from the date of issuance. /Renewals may be granted only if the applicant again passes an ~amination'or foo&, hand- l~rt s course, as in the case of new pennits. iI"', " (3) Definition~ The term food handler as used hereinlTreans any person who works in a restaurant, hotel, lunch-counter, sodS. fountain, ~1io:Et drink, stand, bar, drug store, grocery store, meat market, or any other place where food and/or beverages are prepared, distributed, or served for , human consUlllption, and who handles such food or beverages or partia.ipates in the preparation, distribution, or serving thereOf, or in the handling or washing of dishes or utensils used in the preparation, distribution, or serving thereof; or any person who peddles food or beverages for hUlllan . .' r C 'f':' ' -:--'__-,-, r'-- r-'-' ---, Ilr "" . The term food handler does not include persons who work in private homes or boarding houses, or in places where food or beverages are 0, soid occasionally and not as a regular business by social or charitable organizations or groups. (4) Penalty. Any person who is employed as or engages in the occupation of a food handler without having a permit as herein required, and any person who employes as a food handler a person not having a permit for such employment, shall be deemed guilty of a misdemeanor and fined not ~xceedingTwo Hundred ($200~ Dollars. (5) Requirements Cumulative. The requirements of this ordinance shall be cumulative of the provisions of all other ordinances regulating the - handling of food. (6) Sever~bility Clause. If any part of this ordinance be held uncon- stitutional or void, such part shall be deemed severable and the invalid- ity thereof shall not affect the remain~g parts of this ordinance.
