THAT NO EXCAVATION BE PERMITTED IN, ON OR UNDER THE TWENTY (20) FOOT EASEMENT ,COVERING THE WEST TWENTY (20) FEET OF THE AFORESAID LOTS, AND THAT THE PARKING OF AUTOMOBILES ON TJlE SUR- FACE BE PERMITTED UP TO THE WEST PROPERTY LINE OF LOTS 8" 9 and 10, ,COND!.:, TIONEJj, HOWEVER, TlJAT THE OWNER CONSTRUCT A MASONRY WALL FENCE ON THEw:gST - PROPERTY LINE OF SAID PROPERTY, SAID WALL TO HAVE A HEIGllT OF NCYl'LESS THAN 6 FEET, AND RESERVING TO THE CITY OF WEST UNIVERSITY PLACE THE RIGllTOF INGRESS AND EGRESS IN, ON AND UNDER THE AFORESAID 20 Foar ALLEY AND/OR EAsE- MENT FOR THE PURPOSE, OF LAYING, .MAINTAINING AND REMOVING ANY AND ALL UTILITY LINES, PIPES OR POL$Sj':FIIIDING THAT A PUBLIC HEARING FOR THE PURPOSE OF APPROVING AND ADOPI'ING TBE,REPORT AND RECOMMENDATION OF THE ZONING Am> PLlIN- NING BOARD THAT ORDINANCE 111 BE AMENDE]) TO PERMITTHECDNSTRUCTJIDN OF A COMMERCIAL BUIJ.ll)ING ON SAIDLCYl'SWITH THE AFORESAID MINIMuM s~:aAck REQUIRE- MENTs: FINDING THAT ORDINANCE NO. 111 OF THE CITY OF WEST UNIVERSITY PLACE SHOULD BE AMENDED SO AS TO PERMIT THE CONSTRUCTION OF SUCH COMMERCIAL BUILDING ON LOTS 8, 9 and 10, BLOCK Om: (1), KRENZLERCOURTS, WESTlJNIVERSITY PLACE: AND PROVIDING AND EFFECTIVE DATE. m WHEREAS, Mrs. Emma Krenz:J-er owner of Lots 8, 9 and 10, Block 1, Krenzler Court, West University Place, has heretofore' duly and properly reque~ted that Ordinance No. 111 be amended to permit the construction of acomm.ercial bUilding on said Lots, said bUilding to front on Kirby Drive and have a minimum se~back of 15 feet from the West property line of Kirby Drive and a minimum se~back of 10 feet on Albans Road and WroxtonRoad for a distance underground parking up to ~.but not beyond the property lines on all sides of the twenty' (20) foot easement covering the west twenty (20) feet of the aforesaid lots, and that the parking of automobiles on the surface be per- mitted up to the West property line of Lots 8, 9 and 10, conditioned, however, that. the Owner construct a masonry wall fence on the West property line of said property, said wall to h&ve a height of not less than 6 feet, and re- serving to the City of West University Place the right of ingress andegrees in, on and under the aforesaid 20-foot alley and/or easement for the purpose of laying, maintaining' and removing my and all utility lines, 'pipes or poles; ...... '" WHEREAS, the Zoningc,and Planning Board of the City of West University Place, , having duly considered the said request of Mrs. Emma KrenzlEr, has submitted its recommendation that the same should be granted subject to a public hearing before the City Commission of said City; and ] WBEREAS, at a regular meeti~g of the City Commission of the City of West University Place, Texas, head on January 24, 1955, upon the request of Mrs. Emma Krenzler, and upon the recommendation of the Zoning and Planning B~r9.; .it was determined,that a public hearing Should be 'held to consider whether ordinance No. 111 of the City of West University Place, TExas, should be amended so as to permit the construction of the aforesaid commercial building, having the minimum setback requirements as set forth in such request and recommendation; and ' . ~_ _.. 1l"__1 ~-- ~::::J:-- __C ..- ,..-' IIr I.-.-....- .... __i-..o......l~_..... 12 WHEREAS, proper notice of such hearing was given by publication in the 0 Houston Chronicle on January 26, 1955, 'and notice was maiiLed to each of the owners of property lying within 200 feet of Lots 8, 9 and 10, Block 1, Krenzler Courts, West Upiversity Place, of the public hearing to be held in 1955, to consider amending Ordinance No. 111 so as to permit construction of.. such cOIllll1Ercial building; and WHEREAS, PURSUANT TO SUCH NOTICE A PUBLIC HEARING WAS HELD BY THE CITY Commission at the City Hall, 6104 Auden Street, at 7:30 P.M. Monday, February 14, 1955, at which time, ,all testimony,was heard and fully considered by the City Commission as to the advisability of amending Ordinance No. 111 so as to permit the construction of said commercaal BUiilding; and WHEREAS, it appears to the Ci~y Commission from the report and recom- mendation of the building inspector and the Zoning Board and from all evidence and testimony presented at such public hearing that Ordinance No. 111 of the City of West University Place, Texas, should be amended so as to permit the construction of a commercial building on Lots 8, 9 and 10, Block 1, Krenzler Courts, West University Place, said building facing of< Kirby' Drive and having a minimum setback line of 15 feet from the West property line 'of Kirby Drive and a minimum set'back line of 10 feet from Wroxton Road and Albans Road fQr a distance of 131 feet; and providing that the Owner be permitted to excavate for underground parking w:p,to;,"buttj'lOt beyond ,thel'roperty"lines oneall-' sides of"'sata--lots, -save 0' and except that no excavation be permitted in, on or under the twenty (20) foot easement covering the west twenty (20) feet of the aforesaid lots, and the parking of automobiles. on the surface he -permitted up to the West property line of lots 8, 9 and 10, conditioned, however, that the OWner construct a. masonry wall fence on the West property line of said property, said wall to have a height of not less than ~ feet, and reserving to laying under the aforesaid 20 foot alley and Jor easement for the purpose of laying maintaining and removing any and all utility lines, pipes or poles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY P~CE, TEXAS: Section 1. That the City Commission of the City of West University Place, Texas, does hereby find and determine that each and a.ll of the proceedings hereinabove mentioned have been duly and legally taken, and performed in full cOIttpl:l-a.n:c~; with tle laws and charter and ordinances of the City of West University Place, Texas, and tha.t all provisions and requirements of the law and said charter and ordinances prerequisite to the holding of a public hearing for the purpose of considering the amending of the Zoning Ordinance No. 111 have b~en made and fully complies with. Section 2. That the report and recommendation of the Zoning and Planning Board relative to the request of Mrs. Emma Krenzler be and it is he~eby, approved and adopted. Section 3. That section 29 of Ordinance No. 111 of the City of West Univer- 0 sity Place, Texas, is hereby amended by the addition of a sub-paragraph to be known as sub-paragraph no. 11, to read as folluws; ] J D 13 (11) An office building to be constructed in accordance with the plans and specifications submitted to the building inspector cf the City of West University Place, Texas, to face East on Kirby Drive, with a front lot setback of only 15 feet from the West prol)erty line on Kirby Drive and wi th a side lot setback, of onl.Y 10 feet on Albans Road and a' side:lot setback , of only 10 feet on Wroxton Road for a distance of 131 feet, and providing that the Owner be permitted to excavate for underground parking up to, but not beyond the property lines on all' sides of' said lots, save. and except that no excavation be permitted in, on or under the twenty (20) foot easement covering the west twenty (20) feet of the aforesaid lots, and that the parking of automobiles on the surfa.ce be permitted up to the West University Place . property line of Lots 8,9 a.nd 10 conditioned, however, that the Owners con- struct a masonry wall fence on the West property line of said property, said wall to have a height of not less than 6 feet, and reserving to the City of West University Place the right of ingress and egress in, on and under the aforesaid 20 foot alley and/or easement for the purpose of laying, maintaining and remov- ing any and all utility lines, pipes or poles; is hereby permitted to be con- structed on Lots 8, 9 and 10, Block 1, Krenzlef Courts, West University Place, Texas. Section 4. This ordinance shall take effect and be in force immediately from and after its passage and approval. PASSED AND APPROVED THIS 7th DAY OF MARCH, 1955.
